Under Section 151 of The Criminal Procedure Code, 1973 (CrPC), preventive detention means detention of a person without trial and conviction<\/strong> by a court.<\/span><\/td>\nIt is to punish a person for an offence committed by him after trial and conviction<\/strong> in a court.<\/span><\/td>\n<\/tr>\n
Purpose<\/strong>: Its purpose is not to punish a person for a past offence but to prevent him from committing <\/strong><\/span>an offence in the near future.<\/span><\/strong><\/td>\nIts purpose is to punish a person\u00a0<\/strong>for an offence.<\/span><\/td>\n<\/tr>\n
It is only a precautionary measure<\/strong> and based on suspicion.<\/span><\/p>\n

Availability of rights –\u00a0<\/strong><\/span><\/p>\n

Following rights not available<\/strong> to a person arrested or detained\u00a0 under preventive detention law:<\/span><\/p>\n

  • Right to be informed of the grounds of arrest<\/span><\/li>\n
  • Right to consult and be defended by a legal practitioner<\/span><\/li>\n
  • Right to be produced before a magistrate within 24 hours, excluding the journey time<\/span><\/li>\n
  • Right to be released after 24 hours unless the magistrate authorizes further detention\u00a0<\/span><\/li>\n<\/ul>\n<\/td>\n
All these rights are available<\/strong> to a person arrested or detained under a punitive detention law.<\/span><\/td>\n<\/tr>\n
A detainee under preventive detention has no right <\/strong>of personal liberty guaranteed by Article 19 or Article 21.<\/strong><\/span><\/td>\nA detainee under punitive detention can have the right of personal liberty guaranteed by Article 19 or Article 21.<\/strong><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n
