But, do you know that originally there were not six but seven of these rights?<\/p>\n<p>The Fundamental Right to Property (Article 31) was deleted from the list of fundamental rights via 44<sup>th<\/sup> Constitutional Amendment Act 1978. It was made a <strong>legal right <\/strong>under Article 300-A in Part XII of the Constitution.<\/p>\n<p>So, this begs a question that,<\/p>\n<p><em>what is the difference between a fundamental right and a legal right?<\/em><\/p>\n<p>Well, that&#8217;s exactly what we are going to cover in this part of our &#8216;Difference between series&#8217;.<\/p>\n<table style=\"border-collapse: collapse; width: 100%; height: 419px;\">\n<tbody>\n<tr style=\"height: 83px;\">\n<td style=\"width: 50%; text-align: center; height: 83px; background: #222222; color: #ffffff;\">\n<h5><strong>Fundamental Rights<\/strong><\/h5>\n<\/td>\n<td style=\"width: 50%; text-align: center; height: 83px; background: #222222; color: #ffffff;\">\n<h5><strong>Legal Rights<\/strong><\/h5>\n<\/td>\n<\/tr>\n<tr style=\"height: 56px;\">\n<td style=\"width: 50%; height: 56px;\">Protected and guaranteed by the <strong>Constitution<\/strong> of the country.<\/td>\n<td style=\"width: 50%; height: 56px;\">Legal rights are protected and enforced by <strong>ordinary law<\/strong> of the country.<\/td>\n<\/tr>\n<tr style=\"height: 56px;\">\n<td style=\"width: 50%; height: 56px;\">Can only be changed by <strong>amending the<\/strong><br \/>\n<strong>Constitution<\/strong> itself.<\/td>\n<td style=\"width: 50%; height: 56px;\">May be changed by the legislature by <strong>ordinary<\/strong><br \/>\n<strong>process<\/strong> of law making.<\/td>\n<\/tr>\n<tr style=\"height: 28px;\">\n<td style=\"width: 50%; height: 28px;\">Part of the basic structure of the Constitution.<\/td>\n<td style=\"width: 50%; height: 28px;\">Not a part of the Basic structure doctrine.<\/td>\n<\/tr>\n<tr style=\"height: 28px;\">\n<td style=\"width: 50%; height: 28px;\">It cannot be waived-off by an individual.<\/td>\n<td style=\"width: 50%; height: 28px;\">It can be waived-off by an individual.<\/td>\n<\/tr>\n<tr style=\"height: 56px;\">\n<td style=\"width: 50%; height: 56px;\">If these are violated then an individual can move to <strong>Supreme Court or High Court.<\/strong><\/p>\n<ul>\n<li>The remedy to move to SC in case of violation of FR is itself a fundamental right.<\/li>\n<\/ul>\n<\/td>\n<td style=\"width: 50%; height: 56px;\">If these are violated then an individual have to move to <strong>ordinary court<\/strong>\u00a0first.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 50%;\">Individual has these rights against the state.<\/td>\n<td style=\"width: 50%;\">These rights impose a corresponding obligation on the individual (and in some cases state too).
