Ohio, <strong>to determine when inflammatory speech intending to advocate illegal action can be restricted.<\/strong><\/p>\n<p><strong>Detail<\/strong>: In Brandenburg v. Ohio (1969), the \u2018clear and present danger\u2019 test was expanded, and the \u2018imminent lawless action\u2019 test was laid down by the U.S. Supreme Court, which the court has followed since. This test states, \u201c<strong>The constitutional guarantees of free speech and free press do not permit the state to forbid or proscribe advocacy of the use of force or of law violation, except where such advocacy is directed to inciting or producing imminent lawless action\u201d.<\/strong><\/p>\n<p>The word \u2018imminent\u2019 used in the judgment is very important. Imminent means \u2018likely to happen very soon,\u2019 \u2018at hand,\u2019 or \u2018fast approaching.\u2019<\/p>\n<p><strong>In India:<\/strong> Two decisions of the Indian Supreme Court \u2014 Sri Indra Das v. State of Assam (2011) and Arup Bhuyan v. State of Assam (2011) \u2014 followed the decision in Brandenburg v.
