{"id":153198,"date":"2021-12-14T13:06:27","date_gmt":"2021-12-14T07:36:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?page_id=153198"},"modified":"2021-12-14T13:06:27","modified_gmt":"2021-12-14T07:36:27","slug":"panchayat-extension-to-scheduled-areas-pesa-act-1996","status":"publish","type":"page","link":"https:\/\/forumias.com\/blog\/panchayat-extension-to-scheduled-areas-pesa-act-1996\/","title":{"rendered":"Panchayat Extension to Scheduled Areas (PESA) Act, 1996:"},"content":{"rendered":"<p><strong>About the law:<\/strong><\/p>\n<ul>\n<li>The act intends to provide tribal self-rule for people living in scheduled and tribal areas.<\/li>\n<li>To promote local self-governance in rural India, the 73rd constitutional amendment was made in 1992, due to which a three-tier Panchayati Raj Institution was made into a law.\n<ul>\n<li>However, its application to the scheduled and tribal areas under Article 243(M) was restricted.<\/li>\n<\/ul>\n<\/li>\n<li>After the<strong> Bhuria Committee<\/strong> recommendations in 1995, PESA Act 1996 came into existence for<\/li>\n<li>The PESA Act conferred the <strong>absolute powers to Gram Sabha<\/strong>, whereas state legislature has given an advisory role to ensure the proper functioning of Panchayats and Gram Sabhas.<\/li>\n<\/ul>\n<p><strong>Features of the Act:<\/strong><\/p>\n<p style=\"text-align: center\"><strong>Gram sabha:<\/strong><\/p>\n<p><strong>Constitution<\/strong>&#8211; Every village shall have a Gram Sabha consisting of persons whose names are included in the electoral rolls for the Panchayat at the village level.<\/p>\n<p>Gram Sabha to<strong> safeguard and preserve<\/strong> the-<\/p>\n<p style=\"padding-left: 40px\">(a) traditions and customs of the people, and their cultural identity,<br \/>\n(b) community resources, and<br \/>\n(c) customary mode of dispute resolution.<\/p>\n<p>Gram Sabha has <strong>mandatory executive functions<\/strong> to-<\/p>\n<p style=\"padding-left: 40px\">(a) approve plans, programmes and projects for social and economic development.<br \/>\n(b) identify persons as beneficiaries under the poverty alleviation and other programmes.<br \/>\n(c) issue a certificate of utilisation of funds by the Panchayat for the plans; programmes and projects.<\/p>\n<p style=\"text-align: center\"><strong>Gram sabha and Panchayat:<\/strong><\/p>\n<p><strong>Powers exclusive to Gram Sabha\/Panchayat<\/strong> at appropriate level-<\/p>\n<p style=\"padding-left: 40px\">(a) right to mandatory consultation in land acquisition, resettlement and rehabilitation of displaced persons.<br \/>\n(b) Panchayat at an appropriate level is entrusted with planning and management of minor water bodies.<br \/>\n(c) Mandatory recommendations by Gram Sabha or Panchayat at appropriate level prior to grant of prospecting licenses, mining leases, concessions for minor minerals.<\/p>\n<p><strong>Powers endowed to Gram Sabha and Panchayat<\/strong> at appropriate level to-<\/p>\n<p style=\"padding-left: 40px\">(a) regulate sale\/consumption of intoxicants.<br \/>\n(b) ownership of minor forest produce.<br \/>\n(c) prevent land alienation and restore alienated land.<br \/>\n(d) manage village markets.<br \/>\n(e) control over money lending to STs.<br \/>\n(f) control over institutions and functionaries in social sector, local plans including Tribal sub plans and resources<\/p>\n","protected":false},"excerpt":{"rendered":"<p>About the law: The act intends to provide tribal self-rule for people living in scheduled and tribal areas.
