{"id":155651,"date":"2021-12-22T21:51:57","date_gmt":"2021-12-22T16:21:57","guid":{"rendered":"https:\/\/blog.forumias.com\/?page_id=155651"},"modified":"2021-12-22T21:51:57","modified_gmt":"2021-12-22T16:21:57","slug":"united-nations-declaration-on-the-rights-of-indigenous-peoplesundrip","status":"publish","type":"page","link":"https:\/\/forumias.com\/blog\/united-nations-declaration-on-the-rights-of-indigenous-peoplesundrip\/","title":{"rendered":"United Nations Declaration on the Rights of Indigenous Peoples(UNDRIP)"},"content":{"rendered":"<p><strong>About the Declaration:<\/strong><\/p>\n<ul>\n<li>The Declaration is a comprehensive statement addressing the <strong>human rights of indigenous peoples.<\/strong><\/li>\n<li>It emphasizes rights of indigenous peoples to live in dignity, to maintain and strengthen their own institutions, cultures and traditions and to pursue their <strong>self-determined development,<\/strong> in keeping with their own needs and aspirations\n<ul>\n<li><strong>Other U.N. bodies address indigenous rights<\/strong> through Conventions such as the International<br \/>\nLabour Organization\u2019s<strong>(ILO) Convention No.169<\/strong> and the Convention on Biological Diversity <strong>(CBD) (Article 8j).<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>UN Declarations are generally <strong>not legally binding.\u00a0<\/strong><\/li>\n<li>It was drafted and formally debated for over 20 years prior to being <strong>adopted by the General Assembly in 2007. It was started in\u00a0<\/strong>1982 when the UN-ECOSOC established the Working Group on Indigenous Populations.\n<ul>\n<li>Adopted by a majority of 144 states in favour, 4 votes against (Australia, Canada, New Zealand and the United States) and 11 abstentions.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Rights ensured by the Declaration:<\/strong>\n<ul>\n<li>The Declaration, however, is widely viewed as <strong>not creating new rights.<\/strong><\/li>\n<li>It addresses both individual and collective rights, cultural rights and identity, rights to education, health, employment, language, and others.\n<ul>\n<li>Recognizes subsistence rights and rights to lands, territories and resources.<\/li>\n<\/ul>\n<\/li>\n<li><strong>All human rights and fundamental freedoms<\/strong> as recognized in the Charter of the UN, the Universal Declaration of Human Rights and the rest of international human rights law.<\/li>\n<li>Right to be<strong> free from<\/strong> any kind of <strong>discrimination<\/strong>.<\/li>\n<li><strong>Right to self-determination<\/strong>&#8211; By that right they can freely determine their political status and pursue their economic, social and cultural development.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>About the Declaration: The Declaration is a comprehensive statement addressing the human rights of indigenous peoples.
