{"id":155656,"date":"2021-12-22T22:29:23","date_gmt":"2021-12-22T16:59:23","guid":{"rendered":"https:\/\/blog.forumias.com\/?page_id=155656"},"modified":"2021-12-22T22:29:23","modified_gmt":"2021-12-22T16:59:23","slug":"national-commission-for-women","status":"publish","type":"page","link":"https:\/\/forumias.com\/blog\/national-commission-for-women\/","title":{"rendered":"National Commission for Women"},"content":{"rendered":"<p><strong>About the Commission:<\/strong><\/p>\n<ul>\n<li>It is a<strong> statutory body<\/strong> setup in January 1992 under the National Commission for Women Act, 1990.\n<ul>\n<li>The <strong>Committee on the Status of Women in India (CSWI)<\/strong> recommended the setting up of a National Commission for women for surveillance functions, redressal of grievances and to accelerate the socio-economic development of women.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Mandate<\/strong>: To review the Constitutional and Legal safeguards for women, recommend remedial legislative measures, facilitate redressal of grievances and advise the Government on all policy matters affecting women.\n<ul>\n<li>works on complaints referred to it and can also act <strong>suo-moto<\/strong> in several cases to provide speedy justice.<\/li>\n<li><strong>present to the Central Government<\/strong>, annually and at such other times as the Commission may deem fit, <strong>reports<\/strong> upon the working of those safeguard,<\/li>\n<li>review, from time to time, the exiting provisions of the Constitution and other laws affecting women and recommend amendments thereto<\/li>\n<li><strong>fund litigation<\/strong> involving issues affecting a large body of women,<\/li>\n<li><strong>inspect<\/strong> or cause to inspected<strong> place of custody<\/strong> where women are kept as prisoners or otherwise and take up with the concerned authorities for remedial action, if found necessary,<\/li>\n<li>Work on any other matter which may be referred to it by Central Government.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Power of the Commission:<\/strong><\/p>\n<p>The Commission shall, while investigating any matter, have all the <strong>powers of a civil court trying a suit<\/strong> and, in particular in respect of the following matters, namely :-<\/p>\n<ul>\n<li>summoning and enforcing the attendance of any person from any part of India and examining him on oath,<\/li>\n<li>requiring the discovery and production of any document,<\/li>\n<li>receiving evidence on affidavits,<\/li>\n<li>requisitioning any public record or copy thereof from any court or office,<\/li>\n<li>issuing commissions for the examination of witnesses and documents, and<\/li>\n<li>any other matter which may be prescribed.<\/li>\n<\/ul>\n<p><strong>Members: <\/strong>The Commission shall consist of :-<\/p>\n<ul>\n<li>A <strong>Chairperson<\/strong>, committed to the cause of women, to be nominated by the Central Government.<\/li>\n<li><strong>5 Members<\/strong> to be nominated by the Central Government.\n<ul>\n<li>Provided that <strong>at least one Member each<\/strong> shall be from amongst persons <strong>belonging to the Scheduled Castes and Scheduled Tribes<\/strong> respectively;<\/li>\n<\/ul>\n<\/li>\n<li><strong>A Member-Secretary<\/strong> to be nominated by the Central Government who shall be :-\n<ul>\n<li>an expert in the field of management, organisational structure or sociological movement, or<\/li>\n<li>an officer who is a member of a civil service of the Union or of an all-India service or holds a civil post under the Union with appropriate experience.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Mandate of Governments:<\/strong><\/p>\n<ul>\n<li>The Central Government shall cause all the <strong>reports<\/strong> referred <strong>to be laid before each House of Parliament<\/strong> along with memorandum explaining the action taken or proposed to be taken on the recommendations relating to the Union and the reasons for the non-acceptance, if any, of any such recommendations.<\/li>\n<li>Where any such report or any part thereof relates to <strong>any matter with which any State Government is concerned<\/strong>, the Commission shall forward an copy of such report or part to such State Government who shall cause it to be laid before the Legislature of the State along with a memorandum explaining the action taken or proposed to be taken on the recommendations relating to the State and the reasons for the non-acceptance,if any, of any such recommendations.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>About the Commission: It is a statutory body setup in January 1992 under the National Commission for Women Act, 1990.
