{"id":156825,"date":"2021-12-28T23:50:27","date_gmt":"2021-12-28T18:20:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?page_id=156825"},"modified":"2021-12-28T23:50:27","modified_gmt":"2021-12-28T18:20:27","slug":"enforcement-directorate-ed-2","status":"publish","type":"page","link":"https:\/\/forumias.com\/blog\/enforcement-directorate-ed-2\/","title":{"rendered":"Enforcement Directorate (ED)"},"content":{"rendered":"<p><strong>About:<\/strong><\/p>\n<ul>\n<li>It is a <strong>specialized financial investigation<\/strong> <strong>agency<\/strong> under the <strong>Department of Revenue<\/strong>, Ministry of Finance.<\/li>\n<li>Its <strong>Headquarters<\/strong> at <strong>New Delhi<\/strong> is headed by the Director of Enforcement.<\/li>\n<li><strong>Origin-<\/strong> On <strong>1 May 1956<\/strong>, an <strong>\u2018Enforcement Unit\u2019 was formed<\/strong>, in the Department of Economic Affairs, for handling Exchange Control Laws violations under Foreign Exchange Regulation Act, 1947.\n<ul>\n<li>In the <strong>year 1957<\/strong>, this Unit was <strong>renamed as \u2018Enforcement Directorate\u2019.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Mandate<\/strong>&#8211; It has been given the task of enforcing the provisions of two special fiscal laws\n<ul>\n<li>Foreign Exchange Management Act, <strong>1999 (FEMA).<\/strong><\/li>\n<li>The Prevention of Money Laundering Act, <strong>2002 (PMLA).<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Functions:<\/strong><\/p>\n<ul>\n<li>To collect, develop and disseminate intelligence relating to violations of FEMA, 1999, the intelligence inputs are received from various sources such as Central and State Intelligence agencies, complaints etc.<\/li>\n<li>To investigate suspected violations of the provisions of the FEMA, 1999 relating to activities such as <strong>\u201chawala\u201d foreign exchange<\/strong> racketeering, non-realization of export proceeds, non-repatriation of foreign exchange and other forms of violations under FEMA, 1999.<\/li>\n<li>To <strong>adjudicate<\/strong> cases of violations of the erstwhile <strong>FERA, 1973 and FEMA, 1999.<\/strong><\/li>\n<li>To <strong>process and recommend cases for preventive detention under<\/strong> the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (<strong>COFEPOSA<\/strong>).<\/li>\n<li>To undertake <strong>survey, search, seizure, arrest, prosecution<\/strong> action etc. <strong>against offender of PMLA<\/strong> offence.<\/li>\n<li>To provide and <strong>seek mutual legal assistance<\/strong> to\/from contracting states in respect of attachment or confiscation of proceeds of crime as well as in respect of transfer of accused persons under PMLA.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>About: It is a specialized financial investigation agency under the Department of Revenue, Ministry of Finance.
