It is applicable to\u00a0<strong>all associations, groups, and NGOs<\/strong>\u00a0which intend to receive foreign donations. It is\u00a0mandatory for all such NGOs\u00a0to register themselves under the FCRA.\u00a0Recently the Government of India suspended the FCRA licence of the country\u2019s premier think tank, the Centre for Policy Research (CPR).<\/p>\n<h2><strong>Implications of acting against NGOs:<\/strong><\/h2>\n<ul>\n<li>Collaboration with the world requires the flow of information, personnel and funds in both directions. Along with public funding, private and philanthropic funding are <strong>essential for India<\/strong> <strong>to continuously expand<\/strong> its knowledge horizons in all fields.<\/li>\n<li>The action against the CPR <strong>lowers the bar of tolerance<\/strong> for the political establishment to an abysmal level.<\/li>\n<li>Improving education and tribal welfare is part of the list of activities under <strong>corporate social responsibility <\/strong> Restrictions on NGOs might create confusion about the status of corporate programmes in which they have invested money.<\/li>\n<li>NGOs have to prove that their work does not qualify\u00a0as harmful <strong>to \u201cpublic interest\u201d or \u201cnational security\u201d<\/strong>. The 2020 amendment of FCRA has left these terms\u00a0<strong>undefined and ambiguous<\/strong><strong>.<\/strong> This may lead to\u00a0<strong>subjective interpretations<\/strong>on the part of MHA officials.<\/li>\n<li>The\u00a0enhanced compliance formalities have resulted in the closure of many NGOs and the <strong>livelihood loss<\/strong> of people working in them. For instance,\u00a0the capping of administrative expenditure at 20%\u00a0has made them unviable. This is especially true for NGOs hiring professionals like lawyers and doctors who charge hefty fees for their services.<\/li>\n<li>Many\u00a0prominent NGOs\u00a0like Amnesty International, Greenpeace India, etc. have\u00a0lost\u00a0their FCRA licenses in the past few years.\u00a0 Many of these NGOs work in\u00a0<strong>very critical fields an<\/strong>d most often where state helps fails to reach, like\u00a0pollution and climate change issues, human rights, child labour and human slavery. They, therefore, have a strong\u00a0<strong>impact<\/strong><strong>on the progress of the nation and welfare of the poor.<\/strong><\/li>\n<\/ul>\n<p>Civil society supplements government works and works at the grass-roots level.
