In this chapter, we will see how the Indian Constitution has worked in the last 69 years.<\/span><\/p>\n<p><span class=\"fontstyle3\">2.<\/span><span class=\"fontstyle0\">The Constitution of India was adopted on 26 November 1949.<\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle0\">Its implementation formally started from 26 January 1950.<\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle0\">Article 368 (Part 20) of Indian constitution<\/span><span class=\"fontstyle3\">, empowers parliament to accepts the necessity of modifications<br \/>\naccording to changing needs of the society.<\/span><\/p>\n<p><span class=\"fontstyle2\">5. <\/span><span class=\"fontstyle3\">This is why Indian Constitution is a living document.<\/span><\/p>\n<p><span class=\"fontstyle2\">6. <\/span><span class=\"fontstyle4\">Article 368<\/span><span class=\"fontstyle5\">: empower parliament to amend the constitution.<\/span><\/p>\n<p><span class=\"fontstyle5\"><br \/>\n<\/span><strong><span class=\"fontstyle0\">HOW TO AMEND THE CONSTITUTION <\/span><span class=\"fontstyle3\">?<br \/>\n<\/span><\/strong><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">Indian Constitution is \u2018flexible\u2019 and at the same time it is \u2018rigid\u2019 also.<\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">Flexible means open to changes and rigid means resistant to changes. <\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">A constitution that can be very easily changed or modified is often called flexible.<\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">In the case of constitutions, which are very difficult to amend, they are described as rigid.<\/span><\/p>\n<p><span class=\"fontstyle2\">5. <\/span><span class=\"fontstyle3\">The Indian Constitution combines both these characteristics.<\/span><\/p>\n<p><span class=\"fontstyle3\">6.S<\/span><span class=\"fontstyle0\">imple majority in Parliament<\/span><span class=\"fontstyle3\">: as mentioned in some articles<br \/>\n<\/span><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 i) <\/span><span class=\"fontstyle3\">There are many articles in the Constitution,which can be amended by a simple law of the Parliament.<\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 ii) <\/span><span class=\"fontstyle3\">No special procedure for amendment is required in such cases <\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 iii) <\/span><span class=\"fontstyle3\">E.g. creation of new states, alteration of state boundary etc.<\/span><\/p>\n<p><span class=\"fontstyle2\">7. <\/span><span class=\"fontstyle0\"><span style=\"text-decoration: underline;\"><strong>Special majority in Parliament in both Houses separately: as per article 368<\/strong><\/span><br \/>\n<\/span><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 i) <\/span><span class=\"fontstyle3\">Amendment to the Constitution requires two different kinds of special majorities:<\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 ii) <\/span><span class=\"fontstyle3\">in the first place, those voting in favour of the amendment bill should constitute at least half of the total\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0strength of that House.<\/span><\/p>\n<p><span class=\"fontstyle3\">\u00a0 \u00a0 \u00a0 \u00a0iii) <\/span><span class=\"fontstyle3\">Secondly, the supporters of the amendment bill must also constitute <\/span><span class=\"fontstyle0\">two-thirds <\/span><span class=\"fontstyle3\">of those who actually\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 take part in voting.<\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0iv) <\/span><span class=\"fontstyle5\">Both Houses of the Parliament must pass the amendment bill separately <\/span><span class=\"fontstyle3\">in this same manner<\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0v) <\/span><span class=\"fontstyle0\">There is no provision of joint seating for constitutional amendment. <\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0vi) <\/span><span class=\"fontstyle3\">For every amendment bill, this special majority is required. <\/span><\/p>\n<p><span class=\"fontstyle5\">\u00a0 \u00a0 \u00a0 \u00a0vii)Both the Houses must pass the amendment bill (by special majority) separately<\/span><span class=\"fontstyle3\">.<\/span><\/p>\n<p><span class=\"fontstyle3\">8. <\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">Special majority + ratification by Legislatures of half the states: Article 368<\/span><\/strong><\/span><\/p>\n<p><span class=\"fontstyle0\">\u00a0 \u00a0 \u00a0 \u00a0i)<\/span><span class=\"fontstyle3\">For some articles of the Constitution, special majority is not sufficient ,<\/span><\/p>\n<p><span class=\"fontstyle3\">\u00a0 \u00a0 \u00a0 \u00a0ii)R<\/span><span class=\"fontstyle3\">atification by half of the state legislature is also required c<\/span><span class=\"fontstyle3\">onsent of only half the States is required and\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span><span class=\"fontstyle6\">\u00a0<\/span><span class=\"fontstyle3\">simple majority of the State legislature is sufficient.<\/span><\/p>\n<p>iii) <span class=\"fontstyle0\">When an amendment aims to modify federal matter, it is necessary that the States must be consulted\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 and that they give their consent.<\/span><\/p>\n<p><span class=\"fontstyle2\">9. <\/span><span class=\"fontstyle3\">Note that all amendments to the Constitution are initiated only in the Parliament.<br \/>\n<\/span><\/p>\n<p><span style=\"text-decoration: class=\"fontstyle2\">1. <\/span><span class=\"fontstyle0\">Supreme Court in <\/span><span class=\"fontstyle3\">Kesavananda Bharati case 1973 outlined the basic structure doctrine.<\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">It has set specific limits to Parliament\u2019s power to amend the Constitution.<\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">It says that no amendment can violate the basic structure of the Constitution.<\/span><\/p>\n<p><span class=\"fontstyle3\">4.<\/span><span class=\"fontstyle3\">It allows Parliament to amend any and all parts of the Constitution (within this limitation)<\/span><\/p>\n<p><span class=\"fontstyle2\">5.<\/span><span class=\"fontstyle3\">It places the Judiciary as the final authority in deciding if an amendment violates basic structure <\/span><span class=\"fontstyle3\">and what\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0constitutes the basic structure.<br \/>\n<\/span><\/p>\n<p><span class=\"fontstyle3\">Judiciary and its interpretation have practically amended the Constitution without a formal amendment. In the year 2000 a commission to review the working of the Constitution was appointed under the chairmanship of\u00a0 <\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">Justice Venkatachaliah <\/span><\/strong><\/span><span class=\"fontstyle3\"><span style=\"text-decoration: underline;\"><strong>.<\/strong><\/span><br \/>\n<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chapter 9 : CONSTITUTION AS A LIVING DOCUMENT 1.
