Local government is government at the village and district level. <\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">Local government is about the government closest to the common people.<\/span><\/p>\n<p><span class=\"fontstyle3\">3.<\/span><span class=\"fontstyle2\">\u00a0<\/span><span class=\"fontstyle3\">Local government is about the government that involves the day-to-day life and problems of ordinary citizens.<\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">Democracy is about meaningful participation. It is also about accountability.<\/span><\/p>\n<p><span class=\"fontstyle3\">5.<\/span><span class=\"fontstyle2\">\u00a0<\/span><span class=\"fontstyle3\">Strong and vibrant local governments ensure both active participation and purposeful accountability.<\/span><\/p>\n<p><span class=\"fontstyle2\">6. <\/span><span class=\"fontstyle3\">It is at the level of local government that common citizens can be involved in decision making concerning<br \/>\ntheir lives, their needs and above all their development.<\/span><\/p>\n<p><span class=\"fontstyle2\">7. <\/span><span class=\"fontstyle3\">Common people are more familiar with their local government than with the government at the State or national level.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">GROWTH OF LOCAL GOVERNMENT IN INDIA<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">In modern times, elected local government bodies were created after 1882. <\/span><\/p>\n<p><span class=\"fontstyle0\">2. Lord Ripon<\/span><span class=\"fontstyle3\">, who was the Viceroy of India at that time, took the initiative in creating these bodies <\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">During India\u2019s freedom movement, Mahatma Gandhi had strongly pleaded for decentralisation of economic and political power. <\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">Panchayats therefore were looked upon as instruments of decentralisation and participatory democracy.\u00a0<\/span><\/p>\n<p><span class=\"fontstyle2\">5.\u00a0 <\/span><span class=\"fontstyle0\">When the Constitution was prepared, the subject of local government was assigned to the States<\/span><span class=\"fontstyle3\">.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">Local Governments in Independent India<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">Local governments got a fillip after the <\/span><span class=\"fontstyle0\">73rd and 74th Constitution Amendment Act 1992<\/span><span class=\"fontstyle3\">. <\/span><\/p>\n<p><span class=\"fontstyle3\">2. In 1989 the <\/span><span class=\"fontstyle0\">P.K.Thungon Committee <\/span><span class=\"fontstyle3\">recommended constitutional recognition for the local government\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0bodies.<br \/>\n<\/span><\/p>\n<p><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">Committees related to local government in India<\/span><\/strong><\/span><\/p>\n<p><span class=\"fontstyle3\">1.PRI committee (73rd &amp; 74th Act passed in 1992 and came into force on 24 april 1993 )<\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle0\">Jan1957 Balwant Rai G Mehta committee:<br \/>\n<\/span><span class=\"fontstyle4\">i) <\/span><span class=\"fontstyle3\">recommended Democratic decentralization, 3 tier Panchayati Raj system,village panchayat,DM(as a chairman of zila parishad)<\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle0\">Ashok Mehta committee in Dec 1977<br \/>\n<\/span><span class=\"fontstyle4\">i) <\/span><span class=\"fontstyle3\">2 tier Panchayati Raj system , Nyaya Panchayat<\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle0\">GVK Rao Committee 1985<br \/>\n<\/span><span class=\"fontstyle4\">i) <\/span><span class=\"fontstyle3\">post of DDC should be created<br \/>\n<\/span><\/p>\n<p><span class=\"fontstyle2\">5. <\/span><span class=\"fontstyle0\">LM Singhvi Committee 1986<br \/>\n<\/span><span class=\"fontstyle4\">i) <\/span><span class=\"fontstyle3\">recommended PRI should be constitutionally recognized<\/span><\/p>\n<p><span class=\"fontstyle3\">ii)Nyaya Panchayat should be established <\/span><\/p>\n<p><span class=\"fontstyle3\">iii)<\/span><span class=\"fontstyle3\">judicial tribunal\u00a0<\/span><\/p>\n<p><span class=\"fontstyle3\">iv)Local self govt.<\/span><\/p>\n<p><span class=\"fontstyle2\">6. <\/span><span class=\"fontstyle0\">Thungon Committee , 1988<\/span><\/p>\n<p><span class=\"fontstyle0\">i) <\/span><span class=\"fontstyle3\">PRI should be constitutionally recognized<\/span><\/p>\n<p><span style=\"background-color: var(--global--color-background); color: var(--global--color-primary); font-family: var(--global--font-secondary); font-size: var(--global--font-size-base);\">ii)3-\u00a0<\/span><span class=\"fontstyle3\">tier panchayatti Raj system\u00a0<\/span><\/p>\n<p><span class=\"fontstyle3\">iii)5 year tenure\u00a0<\/span><\/p>\n<p><span class=\"fontstyle3\">iv) State finance commission should be setup in each state<\/span><\/p>\n<p><span class=\"fontstyle3\">v) DM as CEO of Zila Parishad<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">73<\/span><span class=\"fontstyle0\">rd <\/span><span class=\"fontstyle0\">AND 74<\/span><span class=\"fontstyle0\">th <\/span><span class=\"fontstyle0\">AMENDMENTS<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">In 1989, the central government introduced two constitutional amendments. These amendments aimed<br \/>\nat strengthening local governments<br \/>\n<\/span><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">Later in 1992, the 73rd and 74th constitutional amendments were passed by the Parliament.<\/span><\/p>\n<p><span class=\"fontstyle2\">3.<\/span><span class=\"fontstyle3\">The 73rd Amendment is about rural local governments (which are also known as Panchayati Raj Institutions or<br \/>\nPRIs) <\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">74th amendment made the provisions relating to urban local government (Nagarpalikas).<\/span><\/p>\n<p><span class=\"fontstyle2\">5. <\/span><span class=\"fontstyle3\">The <\/span><span class=\"fontstyle5\">73rd and 74th Amendments came into force on 24 April 1993<\/span><span class=\"fontstyle3\">.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">Features added through 73th CAA 1992<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">All States now have a uniform three tier Panchayati Raj structure.<\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">At the base is the \u2018Gram Panchayat\u2018. A Gram Panchayat covers a village or group of villages. <\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">The intermediary level is the Mandal (also referred to as Block or Taluka). These bodies are called Mandal or<br \/>\nTaluka Panchayats. <\/span><span class=\"fontstyle3\">The intermediary level body need not be constituted in smaller States.<br \/>\n<\/span><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">At the apex is the <\/span><span class=\"fontstyle7\">Zilla Panchayat <\/span><span class=\"fontstyle3\">covering the entire rural area of the District.<\/span><\/p>\n<p><span class=\"fontstyle2\" style=\"background-color: var(--global--color-background); color: var(--global--color-primary); font-family: var(--global--font-secondary); font-size: var(--global--font-size-base);\">5. <\/span><span class=\"fontstyle3\" style=\"background-color: var(--global--color-background); color: var(--global--color-primary); font-family: var(--global--font-secondary); font-size: var(--global--font-size-base);\">The Gram Sabha would comprise all the adult members registered as voters in the Panchayat area.\u00a0<\/span><\/p>\n<p><span class=\"fontstyle2\">6.<\/span><span class=\"fontstyle0\">Elections<\/span><span class=\"fontstyle3\">: All the three levels of Panchayati Raj institutions are <\/span><span class=\"fontstyle7\">elected directly by the people<\/span><span class=\"fontstyle3\">.<\/span><\/p>\n<p><span class=\"fontstyle2\">7.<\/span><span class=\"fontstyle3\">The term of each Panchayat body is <\/span><span class=\"fontstyle0\">five years.<\/span><\/p>\n<p><span class=\"fontstyle2\">8. <\/span><span class=\"fontstyle3\">If the State government dissolves the Panchayat before the end of its five year term, fresh elections must be held <\/span><span class=\"fontstyle0\">within six months <\/span><span class=\"fontstyle3\">of such dissolution.<\/span><\/p>\n<p><span class=\"fontstyle2\">9. <\/span><span class=\"fontstyle0\">Reservations <\/span><span class=\"fontstyle3\">: <\/span><span class=\"fontstyle5\">One third of the positions in all panchayat institutions are reserved for women<\/span><span class=\"fontstyle3\">.<\/span><\/p>\n<p><span class=\"fontstyle2\">10. <\/span><span class=\"fontstyle3\">Reservations for Scheduled Castes and Scheduled Tribes are also provided for at all the three levels, in<br \/>\nproportion to their population.<\/span><\/p>\n<p>11.T<span class=\"fontstyle0\">ransfer of Subjects <\/span><span class=\"fontstyle3\">: 29 subjects, which were earlier in the State list of subjects, are listed in the Eleventh<br \/>\nSchedule of the Constitution.<br \/>\n<\/span><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 i) <\/span><span class=\"fontstyle3\">These subjects are to be transferred to the Panchayati Raj institutions.<br \/>\n<\/span><span class=\"fontstyle6\">\u00a0 \u00a0 \u00a0 \u00a0 ii)<\/span><span class=\"fontstyle3\">The actual transfer of these functions depends upon the State legislation.<br \/>\n<\/span><span class=\"fontstyle2\">12. <\/span><span class=\"fontstyle3\">Article 243G. Powers, authority and responsibilities of Panchayats.<\/span><\/p>\n<p><span class=\"fontstyle2\">13. <\/span><span class=\"fontstyle3\">The provisions of the 73rd amendment were not made applicable to the areas inhabited by the Adivasi<br \/>\npopulations in many States of India. <\/span><span class=\"fontstyle3\">In 1996, a separate act was passed extending the provisions of the Panchayat system to these areas known as <\/span><span class=\"fontstyle0\">PESA Act 1996.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">State Election Commission (Article 243k) <\/span><span class=\"fontstyle3\">:<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1.<\/span><span class=\"fontstyle3\">The <\/span><span class=\"fontstyle7\">State government is required to appoint a State Election Commissioner <\/span><span class=\"fontstyle3\">who would be responsible for conducting elections to the Panchayati Raj institutions.<\/span><\/p>\n<p><span class=\"fontstyle3\">2.<\/span><span class=\"fontstyle3\">The <\/span><span class=\"fontstyle5\">office of the State Election Commissioner is autonomous <\/span><span class=\"fontstyle3\">like the Election Commissioner of India. <\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle0\">State Election Commission is an independent office and is not linked to nor is this office under the control<br \/>\nof the Election Commission of India.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">State Finance Commission (Article 243-I)<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">The State government is required to appoint a State Finance Commission once in five years. <\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">This Commission would <\/span><span class=\"fontstyle7\">examine the financial position of the local governments &amp; Urban local bodies <\/span><span class=\"fontstyle3\">in the<br \/>\nState.<\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">It would also review the distribution of revenues between the State and local governments, urban local<br \/>\nbodies on the one hand and between rural and urban local governments on the other.<br \/>\n<\/span><\/p>\n<p><span class=\"fontstyle0\">74th Amendment Act 1992<br \/>\n<\/span><span class=\"fontstyle2\">1. <\/span><span class=\"fontstyle3\">74th amendment dealt with urban local bodies or Nagarpalikas.<br \/>\n<\/span><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">The Census of India defines an urban area as having: <\/span><\/p>\n<p><span class=\"fontstyle3\">\u00a0 \u00a0 \u00a0(i) a minimum population of 5,000<\/span><\/p>\n<p><span class=\"fontstyle6\">\u00a0 \u00a0 <\/span><span class=\"fontstyle3\">(ii) at least 75 per cent of male working population engaged in non-agricultural occupations <\/span><\/p>\n<p><span class=\"fontstyle3\">\u00a0 \u00a0 (iii) a density of population of at least 400 persons per sq. km.<\/span><\/p>\n<p><span class=\"fontstyle3\">3.<\/span><span class=\"fontstyle3\">In many ways the 74th amendment is a repetition of the 73rd amendment, except that it applies to urban<br \/>\nareas.<\/span><\/p>\n<p><span class=\"fontstyle2\">4.<\/span><span class=\"fontstyle3\">Constitution also mandated the transfer of a list of functions from the State government to the urban<br \/>\nlocal bodies. <\/span><span class=\"fontstyle3\">These 18 functions have been listed in the Twelfth Schedule of the Constitution.<\/span><\/p>\n<p><span class=\"fontstyle3\"><br \/>\n<\/span><span style=\"text-decoration: underline;\"><strong><span class=\"fontstyle0\">IMPLEMENTATION OF 73RD AND 74TH AMENDMENTS<br \/>\n<\/span><\/strong><\/span><span class=\"fontstyle2\">1.<\/span><span class=\"fontstyle3\">All States have now passed a legislation to implement the provisions of the 73rd and 74th amendments.<\/span><\/p>\n<p><span class=\"fontstyle2\">2. <\/span><span class=\"fontstyle3\">Today there are more than 600 Zilla Panchayats, about 6,000 block or intermediary Panchayats, and 2,40,000<br \/>\nGram Panchayats in rural India <\/span><span class=\"fontstyle3\">and over 100 city Corporations, 1400 town Municipalities and over 2000 Nagar Panchayats in urban India.<\/span><\/p>\n<p><span class=\"fontstyle2\">3. <\/span><span class=\"fontstyle3\">More than 32 lakh members are elected to these bodies every five years.<\/span><span class=\"fontstyle3\">Of these, at least 13 lakhs are women.<\/span><\/p>\n<p><span class=\"fontstyle2\">4. <\/span><span class=\"fontstyle3\">The 73rd and 74th amendments have created uniformity in the structures of Panchayati Raj and Nagarpalika institutions across the country.<\/span><\/p>\n<p><span class=\"fontstyle2\">5. <\/span><span class=\"fontstyle3\">Reservation for women in Panchayats and Nagarpalikas has ensured the presence of a significant number of women in local bodies.<\/span><\/p>\n<p><span class=\"fontstyle2\">6. <\/span><span class=\"fontstyle3\">Reservations for Scheduled Castes and Tribes are mandated by the constitutional amendment, <\/span><span class=\"fontstyle3\">most States have also made a provision to reserve seats for Backward Castes.<br \/>\n7. Local bodies have very little funds of their own. The dependence of local bodies on the State and central<br \/>\ngovernments for financial support has greatly eroded their capacity to operate effectively.<br \/>\n<\/span><\/p>\n<p><span class=\"fontstyle3\">While <\/span><span class=\"fontstyle7\">rural local bodies raise 0.24% of the total revenues collected, they account for 4% of the total expenditure<br \/>\nmade by the government. <\/span><span class=\"fontstyle3\">So they earn much less than they spend.
