A constitutional bench refers to a special panel of judges that is specifically designated to hear cases related to constitutional issues.<\/p>\n
It usually hears questions of fundamental rights, interpretation of constitution and disputes between different levels of the government.<\/p>\n
As per Article 145(3),<\/span> it consists of at least 5 judges<\/span> of the Supreme Court of India which sit:<\/span><\/p>\n a) To decide any case \u201cinvolving a substantial question of law as to the interpretation\u201d of the Constitution of India or <\/span><\/p>\n b)\u201cFor the purpose of hearing any reference” made by the President of India under Article 143.<\/span> \u00a0<\/span><\/p>\n The term \u2018bench\u2019 has not been mentioned in the Constitution of India.The CJI\u00a0has the power to constitute a Constitution Bench and refer cases to it.
