One or more of the states has considerably more independence than the others, though they have the same constitutional status. The division of powers is not symmetric.<\/p>\n\n\n\n<p><strong>Asymmetric federalism in India:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Special position of Kashmir: <\/strong>During independence majority of\npopulation in the Kashmir valley was Muslim. State acceded to the Indian Union\nunder special terms, which were subsequently incorporated in the Article 370 of\nthe Constitution. This article provided the state with a unique position in the\nIndian Union, with its own constitution. Specifically, the jurisdiction of the Centre\nwas restricted to foreign affairs, defence and communications, with the state\u2019s\nlegislature having residuary powers.<\/li><li><strong>Northeastern hill states: <\/strong>In north-east there is a distinct\ndifference in ethnicity from the rest of India. Several divisions are based on\nculture and other traditions. Most of these states were upgraded from the\nstatus of Union Territories. In Article 371 special powers are accorded to\nnortheastern states. The safeguards provided to these states through these\nspecial provisions include respect for customary laws, religious and social\npractices, restrictions on the ownership and transfer of land, and restrictions\non the migration non-residents to the State. State legislatures are typically\ngiven final control over changes in these provisions.<\/li><\/ol>\n\n\n\n<p><strong>Importance of asymmetric federalism\nin India: <\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Secure rights: <\/strong>These special provisions in the\nConstitution help in protecting fundamental rights, and compensate for initial\ninequalities in the social system. <\/li><li><strong>Social justice: <\/strong>Allowance for separate laws to\ngovern different religious groups, and provisions for various kinds of affirmative\naction for extremely disadvantaged groups help in ensuring justice to them.<\/li><li><strong>Ensure unity in diversity: <\/strong>These provisions respects and\npreserve diversity of the country by protecting vulnerable group through\nspecial powers. This ensure unity in diversity leading to \u2018sabka sath sabka\nvikas\u2019.<\/li><li><strong>Satisfy different needs: <\/strong>It act as a solution to satisfy\ndifferent needs of various federal units, as the result of an ethnic,\nlinguistic or cultural difference. Asymmetric federalism has helped in reducing\ndissatisfaction among various states<\/li><li><strong>Reduce radicalisation: <\/strong>Special powers given to the state of\nJammu and Kashmir help in reducing radicalisation. The state of Jammu and\nKashmir was given special power because the state though include several\ndiverse population, but the majority of the population of the state is Muslim,\nand the state was also near the new country \u201cPakistan\u2019 which is a major\n\u2018Muslim\u2019 country.<\/li><li><strong>Better representation in democracy: <\/strong>It has helped in providing\nrepresentation to minority areas and areas with less population providing them\njustice.<\/li><\/ol>\n\n\n\n<p>The unequal status between various states gives rise to the need for constitutional recognition of inequality, which should be there into the federal polity but in such a way that which protect diversity without sacrificing unity or imposing uniformity. In the Constitution of <\/p>\n\n\n\n<p>In India due to inequality of states and of regions within the state was creating dissatisfaction.
