Investigation agencies are facing many challenges in the investigation of traditional and modern crimes. The investigating agencies need to evolve ways to improve quality of investigation especially for economic and organized crimes and related legal issues. <\/p>\n\n\n\n

Need of\nmodernisation of investigation agencies:<\/strong><\/p>\n\n\n\n

  1. In a large and populous country like India, investigation\nagencies need to be well-equipped, in terms of personnel, weaponry, forensic,\ncommunication and transport support, to perform their role well.<\/li>
  2. They need to have the operational freedom to carry\nout their responsibilities professionally, and satisfactory working conditions\nwhile being held accountable for poor performance or misuse of power.<\/li>
  3. In 2015, the conviction rate for crimes recorded\nunder the Indian Penal Code was 47%. One of the reasons behind this is the poor\nquality of investigations.<\/li>
  4. The social and\ntechnological changes fuelled by the internet and the fast changing social\nmedia nature, intensity and the reach of crime may lead to unprecedented\nlawlessness and frightening dimensions of global terrorism. This require modern\ninvestigation efforts.<\/li>
  5. Traditional and outdated\ndevices used in the past for investigation are not be sufficient. Modern\ndevices like artificial intelligence, robots, drones, CCTVs are required to\nfight increasing crime rates.<\/li>
  6. There are new technology\nrelated challenges which are faced by the law enforcement agencies. Increasing\ncyber crime, fake propagandas demand modern methods of investigation.<\/li>
  7. To succeed in\nidentifying and tracing global communications, investigators have to work\nacross border, not only with one\u2018s counterpart but also with industry to\npreserve critical evidence such as log files, emails etc. before it is altered\nor deleted. <\/li>
  8. With increased\nthreat to privacy of citizens, investigation agencies need modern methods to\nprevent misuse of data.<\/li>
  9. Political\nauthorities still have a stronghold over the police and frequent changes of\nPolice heads once a new government is elected has become a practice in many\nstates. This lead to inefficiencies in police system leading to corruption and\nabuse. <\/li>
  10. Investigation\nagencies need prior permission of government in many cases especially against bureaucrats.\n<\/li>
  11. Investigation in\nthe cases where the high profile people, VIP\u2019s as well political parties are\ninvolved do not succeed. There is direct or indirect interference of political\nparties in the police investigation.<\/li><\/ol>\n\n\n\n

    What\nshould be done?<\/strong><\/p>\n\n\n\n

    1. A complaint authority\nshould be constituted at the state and district levels to inquire into\nallegations of serious misconduct and abuse of power.<\/li>
    2. Separate the\ninvestigating police from the law and order police to ensure speedier\ninvestigation, better expertise and improved rapport with the people.<\/li>
    3. The Political class\nshould take bold initiatives to bring in more reforms in the existing investigation\nsystem in India. The need is to have an impartial and professional organisation\nbecause the criminal justice system cannot function without a healthy\ninvestigative agency.<\/li>
    4. The reforms in the\nIndian Police are required through appropriate interventions in skill building\nand attitudinal training.<\/li><\/ol>\n\n\n\n

      Thus with changing times way and methods of investigation should improve through modernisation and autonomy to investigation agencies. A more political will and nudge is required to achieve it.<\/p>\n","protected":false},"excerpt":{"rendered":"
