Efficient courts are the backbone of the modern economy. A sound judiciary is key to enforcing laws and creating trust in the economy, allowing economic exchange between complete strangers by deterring fraud and increasing the incentives for fair play. Unsurprisingly, then, when the justice system breaks down, the consequences are bad.<\/p>\n\n\n\n<p><strong>Impact of slow\njudiciary on economy:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>A slow judiciary with a large number of pending\ncases reduces trust in the economy and makes people fearful.<\/li><li>It delay contracts enforcement, thereby\nimpinging business. India rank poorly in the category of enforcing contracts.\nIt takes, on average, almost 4 years to enforce a standard sales agreement in a\nlocal court, and costs up to 30% more.<\/li><li>A slow judiciary forces participants to adopt loss-minimising\nstrategies that are not always efficient resulting in rise in the costs of\ngoods and services. E.g. Landowners have to increase the rent significantly or\nask the tenant to deposit a security amount to cover the risk due to the\ninsecurity created by a weak judiciary. <\/li><li>It deters firms from making investments in the\nnation due to low confidence and time to resolve disputes if arise.<\/li><li>A weak judiciary has a negative effect on\neconomic and social development, which leads to lower per capita income, higher\npoverty rates, lower private economic activity, poorer public infrastructure and\nhigher crime rates.<\/li><\/ol>\n\n\n\n<p><strong>Some measures\nto improve judiciary:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Categorisation of disputes under provident fund,\ngratuity or industrial laws before passing them through the resolution can\nreduce the burden on judicial organs.<\/li><li>Thousands of cases and appeals are pending under\nvarious State and municipal laws. These laws can be simplified and should be\nmade more clear with clear rules and regulations.<\/li><li>Retired Supreme Court judge should be employed\nspecifically to opine on pending disputed issues and direct the departments to\neffect a fast resolution. <\/li><li>Bulk disposition by consensus is the way out of\nthe humungous backlog of civil litigation. <\/li><li>Setting up Supreme Court benches in Mumbai,\nChennai and Kolkata would help thousands of litigants who otherwise end up\ntravelling all the way to Delhi. <\/li><li>We can follow the Chinese model where law\nstudents are encouraged to appear for the national judicial examination to\nensure a steady availability of quality judges at least in the lower judiciary.\n<\/li><li>Massive computerisation for case management and\ntechnological framework is needed. <\/li><\/ol>\n\n\n\n<p>Clearing the mounting backlog in our judicial backyard is doable with strong political will.
