Ideas like Linking Aadhar to social media is not only dangerous but also carry high risk to individual privacy but also a threat to democracy.<\/p>\n\n\n\n<p><strong>Difficulty of\nlaw enforcement agencies at investigating cyber-crimes:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Jurisdiction: <\/strong>Most of the time, the\nperson committing the crime is located outside of the country and is out of legal\njurisdiction of the court and prosecutors. <\/li><li><strong>Difficulty\nin defining cyber laws<\/strong>: Internet crime is a recent phenomenon. States have\nhad a hard time figuring out what is or isn\u2019t illegal in the computer world for\na particular location, especially if that crime involves computers or people\noutside of their jurisdiction. <\/li><li><strong>Slow\nand inefficient agencies: <\/strong>It has taken decades for law enforcement\nagencies, legal systems, and juries to get up to speed on cyber crime. Law\nenforcement agencies do not train their officers to recognise the various forms\nof cyber crime, how to collect and preserve related evidence, and how to hire\nand train specialised forensic investigators.<\/li><li><strong>Under-reporting:\n<\/strong>The vast majority of internet crimes are never reported. Most people have\nno idea of where and how to report internet crime.<\/li><\/ol>\n\n\n\n<p><strong>Threats posed\nby linking Aadhar to social media:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Attack on Privacy: <\/strong>The privacy of users\u2019\ndata is at stake. Aadhar contains vital information like age, sex, date of\nbirth, address of the individual. Linking Aadhar to social media would expose\nthis data to cyber criminals. Linking Aadhar and stalking peoples\u2019 is a direct\nimpingement of right to privacy under Article 21.<\/li><li><strong>Threat to democracy:<\/strong> Democracies are\nestablished with the purpose of protecting the rights of their citizens.\nLinking Aadhar to social media is a threat to democracy in a way that it can be\nused to influence elections and voting behaviour of individuals through\nsurveillance. This is a serious threat to people\u2019s power and freedom.<\/li><li><strong>Financial frauds:<\/strong> Aadhar is linked to\nbanks, various social schemes etc. Linking it to social media will expose users\ndata and possibly all the transaction information. Hacker can easily exploit\nhow the money deposits, and may cause a financial fraud risking financial\nsecurity of individual and of our nation. Hackers may use Aadhar info linked to\nsocial media accounts to steal money.<\/li><li><strong>Dark activities: <\/strong>The possibility that the\nlinking Aadhar will nurture illicit activities and markets like drug selling,\nweapons etc through darknet by using stolen ids, Aadhar information from social\nmedia accounts. It also increase risk for being used in various terrorist\nactivities across the border.<\/li><li><strong>Surveillance state:<\/strong> The government\u2019s\nsurveillance may not be always about increasing security. It can be used in the\nto avoid transparency, leading to the loss of basic human rights. Decisions\nabout surveillance are taken by the executive branch (including the review\nprocess), with no parliamentary or judicial supervision.<\/li><li><strong>Threat to social security:<\/strong> Social media\nwebsites keep track of all interactions used on their sites and save them.\nThese companies like Facebook are found to be involved in cyberstalking,\nlocation disclosure, social profiling, 3rd party personal information\ndisclosure, and without the safeguard of a search warrant. Linking Aadhar would\nexpose sensitive info to be out in the market which could be used for\nblackmailing, targeted advertisements etc. infringing social security.<\/li><li><strong>Propagandas:<\/strong> Such exposure of identities\nare threat to social peace and stability by using propagandas, false news and\nfalse ideologies used by various anti-social actors targeting specific\ncommunity and people. Although government would keep eye on such agendas, it is\ndifficult to prevent all of such actors. Further it is very difficult to define\nwhat is fake and what is propaganda.<\/li><\/ol>\n\n\n\n<p>The Supreme Court stressed the need to find a balance between the right to online privacy and the right of the State to detect people who use the web to spread panic and commit crimes.
