Central Vigilance Commission was established in 1964 under the recommendations of Santhanam Committee, it gained statutory authority in 2003 CVC Act. It was envisaged to prevent corruption in governance and hold civil servants responsible for their malafide actions.<\/p>\n\n\n\n

Mandate of the CVC:<\/strong><\/p>\n\n\n\n

  1. It is\nconsidered to be the coordinating authority to check Corruption for All India\nservices, Central services, PSUs and other departments.<\/li>
  2. It heads\nthe Delhi Special Police in cases of Corruption.<\/li>
  3. It reviews\nthe grants of prosecution clearance by the government.<\/li>
  4. It\nrecommend disciplinary actions against higher officials of Group A,B, All India\nservices etc.<\/li>
  5. It is\nbasically considered to be the nodal agency to tackle corruption at the\nnational level.<\/li><\/ol>\n\n\n\n

    Effectiveness of CVC:<\/strong><\/p>\n\n\n\n

    In sync with its mandate CVC has proved to be\nan effective organization in tackling corruption, it has proved its mettle in\nthe past by the following actions.<\/p>\n\n\n\n

    1. It has led\nto smooth appointment of important officers at various posts in the past.<\/li>
    2. It has\ntaken noteworthy action in the past against senior officials, senior personnel\nand even many politicians.<\/li>
    3. It organises\nvigilance week every year to create awareness against the menace of Corruption.<\/li>
    4. It acts as\na civil court and can act \u201cSuo Moto\u201d<\/li>
    5. The\nindependence of CVC is maintained as it is recruited by an Independent\ncommittee consisting of PM, Home Minister, Leader of Opposition etc.<\/li><\/ol>\n\n\n\n

      Some issues:<\/strong><\/p>\n\n\n\n

      However, the expectation that CVC will be an\ninstitute which can prove to be \u201cOne Stop Solution\u201d to tackle Corruption in the\ncountry has been proved to be a hoax, due to the following ineffectiveness-<\/p>\n\n\n\n

      1. The\nDecisions of the CVC are not binding on the organizations or ministries.<\/li>
      2. Very low\nconviction rate has reduced the impact of CVC and its effectiveness.<\/li>
      3. There is\nhuge delay in the cases that CVC handles, hence it does not act as an effective\ndeterrent.<\/li>
      4. CVC is\noften considered a powerless agency as it is treated as an advisory body only\nwith no power to register criminal case against government officials or direct\nCBI to initiate inquiries against any officer of the level of Joint Secretary\nand above.<\/li>
      5. Although\nCVC is \u201crelatively independent\u201d in its functioning, it neither has the\nresources nor the power to take action on complaints of corruption.<\/li>
      6. In most\ncases, the domains and the jurisdiction of the organizations is not clear.<\/li>
      7. Multiplicity\nof organization leads to work duplication and reduces the effectiveness.<\/li>
      8. The post\nof Central Vigilance Commissioner has remained vacant for a long period of\ntime.<\/li><\/ol>\n\n\n\n

        Corruption is one issue that needs effective institutions to tackle the same, the demand of new institutions like Lokpal is on the rise due to the failure of the existing organization like the CVC. The powers of the CVC with respect to its mandate, the financial independence, increase in the implementation of otherwise the just advisory role of the CVC needs to be tackled.<\/p>\n","protected":false},"excerpt":{"rendered":"
