In India, the provisions of the Constitution mainly govern the law\nrelating to citizenship or nationality. The Constitution of India provides for\nsingle citizenship for the entire country. While law and order is a State\nsubject under the Indian Constitution, international relations and\ninternational borders are under the exclusive purview of the Union government.\nThus, all policies governing refugees are laid down by the Union government.<\/p>\n\n\n\n<p><strong>India\u2019s\npolicy on refugees:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Principle of non-refoulement:<\/strong> While India is not a signatory to the UN\nRefugee Convention, 1951, India has followed the principle of non-refoulement\nwhenever helpless asylum seekers have knocked on its doors. <\/li><li><strong>Internal matter: <\/strong>India has not signed the 1967 Protocol and has always maintained it is its internal\nmatter.&nbsp;The Convention requires the signatory nation to accord a minimum\nstandard of hospitality and housing towards those it accepts as refugees. The\nporous nature of borders in South Asia, continuous demographic changes,\npoverty, resource crunch, and internal political discontent made it impossible\nfor India to accede to the Protocol.&nbsp;<\/li><li><strong>Ad hoc refugee policy:<\/strong> India\u2019s refugee policy can be termed as ad hoc\nrefugee policy that allows New Delhi to differentiate between different groups\nin its treatment toward refugees and put other interests over humanitarian\nconcerns.<\/li><li><strong>Open borders policy: <\/strong>India has a history of welcoming refugees as a\nmeans of projecting its relative strength and security as the economic\npowerhouse of South Asia. In the past, the country maintained relatively open\nborders. The two most notable groups in this category are Tibetans (leader-\nDalai Lama) and Sri Lankans, collectively numbering over 150,000.<\/li><li><strong>Legal tenets: <\/strong>Under various laws and provisions, India provides citizenship to many under special\ncircumstances. These are NRC Assam, Citizenship amendment act, 1955 and 2019.\nThere are some laws that govern refugees, including the Registration of\nForeigners Act, 1939; Foreigners Act, 1946, and the Passport Act, 1967.\nRecently, Rohingya crisis and CAA, 2019 has been criticised for not including\nMuslims of some countries to provide early citizenship benefits.<\/li><\/ol>\n\n\n\n<p><strong>How\nshould India tackle the Rohingya crisis?<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Resettlement: <\/strong>Resettlement efforts must be made with the Myanmar from\nwhich Rohingya are moving out. India has extended 7,000 tonne of relief assistance for Rohingya refugees in\nBangladesh. This was followed by a $25-million development programme to help\nMyanmar build the necessary infrastructure to rehabilitate Rohingya in the\ntroubled Rakhine State.<\/li><li><strong>Working with neighbours: <\/strong>India must keep continuing work with other neighbouring countries like Bangladesh so\nthat the refugee influx is better managed and does not cause a permanent strain\non the resources. For instance, under Operation Insaniyat, India has provided\naid to Bangladesh. This aid is given to improve the situation of Rohingya in\nCox\u2019s Bazar region of Bangladesh.<\/li><li><strong>Balancing human rights: <\/strong>The Supreme Court has urged the Indian\nadministration to strike a balance between human rights and national security\ninterests but not stayed the administration\u2019s deportation plans. Thus, India\nshould ensure that human rights are not violated and must provide health, food\nand temporary shelter to Rohingya. <\/li><li><strong>Identity cards:<\/strong> As Myanmar-India have strong cultural ties, India should\ntake proactive steps in solving the situation. India may introduce identity\ncards for refugees so as to allow them temporary relief and enhancing India\u2019s\nsecurity.<\/li><\/ol>\n\n\n\n<p>The absence of a\nframework on refugees in India makes it prone to inconsistent and ad-hoc\nreactions to refugee crises. In order to frame a robust refugee policy, it is\nessential to examine the cause that gives rise to this migration like unstable\npolitical environments, insurgencies by non-state actors etc. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Demand of the question Introduction.
