The 2018 statistics released by the National Crime\nRecords Bureau (NCRB) reveals a 1.3% increase in crime. With the changing\nworld, police and law and order challenges are increasing day by day. Change in\nnature of crime with threats of cyber-crime, suicide bombings, and outdated\npolice force need modernisation. More trained staff and new technological\ninvestigating methods are needed for the hour.<\/p>\n\n\n\n<p><strong>Need\nand significance of police reforms:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Low police-to-population ratio: <\/strong>The\nglobal average ratio of police-population is 270 to 100,000, where it\u2019s 120 in\nIndia. With far less police \u2013ill-equipped and most of them posted to protect\nthe political representatives, people of India are the least secured people on\nthe globe.<\/li><li><strong>Corruption: <\/strong>In 2016, the vigilance\ndepartment had conducted 55% more inquiries against its men. A Delhi Police\nsurvey found 34% of the cops to be corrupt in 2015, down from 66% in 2014.<\/li><li><strong>Changing nature of crime<\/strong>: The recent\nsocial and technological changes fuelled by the internet and the new social\nmedia are fast changing the nature, intensity and the reach of crime leading to\nunprecedented lawlessness and frightening dimensions of global terrorism.<\/li><li><strong>Police misconduct:<\/strong> The lack of effective\naccountability mechanisms and periodic review of performance has misplaced the\npublic\u2019s confidence in the police. Recent attack on police by mob indicates\ncitizens losing trust in police.<\/li><li><strong>Lack of technological capabilities:<\/strong> One\nof the reasons for low conviction rates in India is poor quality of\ninvestigation by police. Police lack modern technological capabilities\nnecessary to perform quality investigations.<\/li><li><strong>Insensitive: <\/strong>Representation of women and\ndepressed caste is low which makes them insensitive towards them. Escalating\nviolence resulting from caste conflicts including the most recent Dalit\nuprising, farmers woes across the country.<\/li><li><strong>Overburdened: <\/strong>Apart from the core\nfunction of maintaining law and order, police personnel carry out various other\nfunctions such as traffic management, disaster rescue and removal of encroachments.&nbsp;These\nextra obligations lead to overburdening of the police force which have negative\nconsequences on their efficiency and performance.<\/li><\/ol>\n\n\n\n<p><strong>Various committees on police reforms:<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"\"><tbody><tr><td>\n <strong>Gore committee, 1971-73<\/strong>\n <\/td><td>\n The main thrust of the Committee&#8217;s\n recommendations was towards enlarging the content of police training from law\n and order and crime prevention to a greater sensitivity and understanding of\n human behaviour.\n <\/td><\/tr><tr><td>\n <strong>National police\n commission, 1977<\/strong>\n <\/td><td>\n Its major recommendations were centred on\n the problem of insulating the police from illegitimate political and\n bureaucratic interference.\n <\/td><\/tr><tr><td>\n <strong>Padmanabhaiah Committee<\/strong>\n <\/td><td>\n In 2000, the Padmanabhaiah Committee on\n Police Reforms was constituted to study, inter alia, recruitment procedures\n for the police force, training, duties and responsibilities, police officers\u2019\n behaviour, police investigations and prosecution.\n <\/td><\/tr><tr><td>\n <strong>Soli Sorabjee Committee<\/strong>\n <\/td><td>\n The Police Act Drafting Committee (PADC\n or Soli Sorabjee Committee) drafted a new model police bill to replace the\n colonial 1861 Police Act.\n <\/td><\/tr><tr><td>\n <strong>2<sup>nd<\/sup> ARC<\/strong>\n <\/td><td>\n The ARC recommended separation of crime\n investigation from other police functions i.e. maintenance of law and order,\n establishment of state police boards, welfare and grievances redressal\n mechanisms for police personnel.\n <\/td><\/tr><tr><td>\n <strong>Supreme Court guidelines<\/strong>\n <\/td><td>\n The 2006 verdict of the Supreme Court in\n the <em>Prakash Singh vs Union of India\n case <\/em>was the landmark in the fight for police reforms in India. The Court\n provide following directives to kick-start reforms:\n Constitute a State Security\n Commission (SSC) to ensure that the state government does not exercise\n unwarranted influence or pressure on the police.Separate the investigation\n and law and order functions of the police.Set up a Police Establishment\n Board (PEB) to decide transfers, postings, promotions and other service\n related matters of police. Set up a Police Complaints\n Authority (PCA) at state level to inquire into public complaints against\n police officers of above the rank of Deputy Superintendent of Police.Set up a National Security\n Commission (NSC) at the union level to prepare a panel for selection and\n placement of Chiefs of the Central Police Organizations (CPO) with a minimum\n tenure of two years.\n \n \n \n \n <\/td><\/tr><tr><td>\n <strong>NITI Aayog<\/strong>\n <\/td><td>\n <strong>State level legislative reforms: <\/strong>States should be encouraged, with fiscal\n incentives, to introduce \u2018The Model Police Act of 2015\u2019 as it modernizes the\n mandate of the police.<strong>Administrative and operational reform:<\/strong>A Task\n Force must be created under the MHA to identify non-core functions that can\n be outsourced.The\n states should be encouraged to ensure that the representation of women in the\n police force is increased.India\n should launch a common nation-wide contact for attending to urgent security\n needs of the citizens.It also\n suggested moving police as well as public\n order to the Concurrent List.\n \n \n \n \n \n <\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>Way\nforward:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Strengthening Criminal Justice System:<\/strong> There is an urgent need to strengthen our\nCriminal Justice System and our grassroots level policing institutions to\nprepare our police to deal with the present and emerging challenges and\nstrengthen its investigative capabilities and emergency response\ninfrastructure.<\/li><li><strong>Focusing lower-level officers:<\/strong> The overall functioning of lower-level officers\ncan be boosted by better training, better pay and allowances and by creating a\nsystem that rewards initiative and positive action instead of negative\nbehaviour.<\/li><li><strong>Independent Complaints Authority:<\/strong> There is a need to have an independent complaints authority\nto inquire into cases of police misconduct. States should have specialised\ninvestigation units within the police force for better investigation of crimes.<\/li><li><strong>Gender sensitive: <\/strong>Police should be made more gender sensitive. 33% women\nreservation in police should be implemented<\/li><li><strong>Political will:<\/strong> There is a need for broader political will about the need for police\nreform. Some states like Kerala and Telangana have tried to take the process\nforward.<\/li><\/ol>\n\n\n\n<p>State police forces are primarily in charge\nof local issues such as crime prevention and investigation, and maintaining law\nand order. Police forces need to adopt modern methods like forensics, data\nanalysis etc. to ensure timely justice.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Demand of the question Introduction.
