It can be performed on various grounds until 24 weeks of\npregnancy. It provides women the right to choose and help in saving women&#8217;s\nlives. Whether it should be legalised unconditionally in India needs to be\nanalysed deeply.<\/p>\n\n\n\n<p><strong>Argument\nin favour of legalisation of abortion in India:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Bodily sovereignty:<\/strong> The first argument is of bodily sovereignty. Each woman\nhas the sole right to make decisions about what happens to her body. No one\nshould force her either to carry or terminate a pregnancy against her will.\nMost abortions are carried out on the grounds of safeguarding the woman&#8217;s\nmental health.<\/li><li><strong>Safeguarding life: <\/strong>Abortions should be done to safeguard the life of a foetus,\nas it would involve risk if pregnancy is carried, it might damage the foetus\nresulting in danger to the life of the mother.<\/li><li><strong>Prevent abandoning of child:<\/strong> A woman who does not want to carry her pregnancy,\nmay abandon the new born child as was seen in the past. This endangers the life of the baby and may lead to his\nabuse. Thus, it is better to terminate the pregnancy at an earlier stage.<\/li><li><strong>Right to choose: <\/strong>Abortion represents a woman\u2019s right to choose and\nreproductive rights whether to continue her pregnancy or terminate it.<\/li><li>&nbsp;<strong>Mother\u2019s life: <\/strong>Legal procedures have\noften hindered in permitting abortion, resulting in the death of a mother or\nthe foetus. Despite the latest techno-medical advances, the laws have remained\nstagnant or rather restrictive, complicated further by selective female foetus\nabortions.&nbsp;<\/li><li><strong>Reproductive rights:&nbsp;<\/strong>The Supreme Court has recognised women\u2019s right\nto make reproductive choices and their decision to abort as a dimension of\ntheir personal liberty (in&nbsp;<em>Mrs. X v.\nUnion of India<\/em>,&nbsp;<em>2017<\/em>) and as\nfalling within the realm of the fundamental right to privacy (in&nbsp;<em>K.S. Puttaswamy v. Union of India<\/em>,&nbsp;<em>2017<\/em>).<\/li><\/ol>\n\n\n\n<p><strong>Argument\nagainst legalisation of abortion in India:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Unsafe: <\/strong>It is estimated that 15.6 million abortions take place in\nIndia every year. A significant proportion of these are expected to be unsafe.\nLegalising abortion would further put mother\u2019s life in danger especially in\nrural areas. <\/li><li><strong>Female foeticide: <\/strong>In India there is a major problem with female foeticide.\nFor sociological and economic reasons parents prefer to have boy babies. When\nparents can discover the gender of the foetus in advance, they sometimes\nrequest the termination of a pregnancy solely because the foetus is female.<\/li><li><strong>Unethical: <\/strong>Abortion is morally wrong because it deprives the foetus of\na valuable future. In a way it snatch foetus\u2019 right to life.<\/li><li><strong>Damages women:<\/strong> Abortion because it can damage the long-term physical and\nemotional health of women who have an abortion.<\/li><li><strong>Women atrocities: <\/strong>Legalising abortion may lead to forceful abortion by the\nhusband or family of husband in want of dowry or son. <\/li><\/ol>\n\n\n\n<p>It can be concluded that although\nlegalising abortion strengthen women\u2019s right to choose, it has much more\nfallouts than advantaged. Women have been oppressed since ages.
