To access complete material<\/strong>\u00a0\u2013\u00a0<strong><a href=\"https:\/\/forumias.com\/blog\/polity\/\" target=\"_blank\" rel=\"noopener\">Click Here\u00a0<\/a><\/strong><\/p>\n<h3>#1 What are Directive Principles<\/h3>\n<p>Dr. BR Ambedkar described the <a href=\"https:\/\/forumias.com\/blog\/polity\/directive-principles-of-state-policy-and-fundamental-duties\/\"><strong>Directive Principles<\/strong><\/a> as the \u201c<em>novel features<\/em>\u201d of the Indian Constitution<strong>. <\/strong>Directive principles, combined with the Fundamental rights have been described as the \u2018<em><u>conscience of the constitution\u2019<\/u><\/em>.<\/p>\n<ul>\n<li>The provisions of Directive principles are contained in the Part IV of the constitution from <strong>Article 36 to 51<\/strong>.<\/li>\n<li>Adopted form the constitution of Ireland.<\/li>\n<li>Similar to \u201c<u>Instrument of Instructions<\/u>\u201d given in the Government of India Act, 1935.<\/li>\n<li>Strives to achieve a \u2018Welfare State\u2019 by bringing about social and economic justice.<\/li>\n<li><strong><u>Article 36<\/u><\/strong> \u2013 The term \u2018State\u2019 carries the same meaning as in Article 12 of Part III (FR).<\/li>\n<li><strong><u>Article 37<\/u><\/strong> \u2013 Directive Principles are non-justiciable in nature, however, they are <strong><u>fundamental to the governance of the country<\/u><\/strong>. Thus it shall be the duty of the State to apply these principles in making laws and public policy.<\/li>\n<\/ul>\n<h3>#2 Categorisation of Directive Principles<\/h3>\n<p><strong>DPSPs have been broadly classified into 3 categories:<\/strong><\/p>\n<ul>\n<li>Socialist Principles<\/li>\n<li>Gandhian Principles<\/li>\n<li>Western liberal Principles<\/li>\n<\/ul>\n<h3>#3 Important Articles related to the Directive Principles<\/h3>\n<ol>\n<li><strong><u>Article 38<\/u><\/strong> &#8211; State to secure a Social order for the promotion of welfare of people. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>By ensuring Justice-Social, Economic and Political.<\/li>\n<li>Minimize inequality among the individuals and Society in general. [Inserted by 44<sup>th<\/sup> Amendment Act]<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong><u>Article 39<\/u><\/strong> &#8211; <u>Certain Principles to be followed by State<\/u>. [<em>Socialist principle<\/em>]<strong><u>Article 39(a)<\/u><\/strong> &#8211; Right to adequate means of Livelihood. E.g.- Rural livelihood mission; MGNREGA etc.<strong><u>Article 39(b)<\/u><\/strong> &#8211; Equitable Distribution of resources.<strong><u>Article 39(c)<\/u><\/strong> &#8211; Prevention of concentration of wealth.\n<ul>\n<li>Example: Progressive Taxation; Land reforms; Nationalization of Corporation etc.<\/li>\n<li>Article 31c &#8211; [25th CAA primary over Article 14 and 19]<\/li>\n<\/ul>\n<p><strong><u>Article 39(d)<\/u><\/strong> &#8211; Equal pay for Equal works for both men and women.<\/p>\n<ul>\n<li>Example: Equal Remuneration Act, 1976<\/li>\n<\/ul>\n<p><strong><u>Article 39(e)<\/u><\/strong> &#8211; Protecting the health and strength of workers, men, women and children.<\/p>\n<ul>\n<li>Example: Plantation Labor Act; Child Labor Prohibition Act etc.<\/li>\n<\/ul>\n<p><strong><u>Article 39(f)<\/u><\/strong> &#8211; Children are given opportunity to develop in healthy manner.<\/p>\n<ul>\n<li>Inserted by 42<sup>nd<\/sup> Amendment Act 1976.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol start=\"3\">\n<li><strong><u>Article 39A<\/u><\/strong>&#8211; Equal Justice and Free Legal Aid. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Inserted by 42<sup>nd<\/sup> Amendment Act 1976.<\/li>\n<li>Example: National Legal Services Authority Act, 1987 (Lok Adalat) covers both criminal and Civil Cases<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><u>Article 40<\/u><\/strong> &#8211; Organization of village Panchayats. [<em>Gandhian principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: 73<sup>rd<\/sup> Amendment Act given constitutional States to village Panchayat<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong><u>Article 41<\/u><\/strong> &#8211; Right to work, education and Public Assistance in certain cases. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: MGNREGA, RTE Act; old age pension scheme; old age homes run by state etc.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li><strong><u>Article 42<\/u><\/strong> &#8211; Provisions for just and Humane condition of works and Maternity relief. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: Maternity Benefit Act; Factories Act; Plantation Labour Act etc.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li><strong><u>Article 43<\/u><\/strong> \u2013 Decent standard of life and Living wage etc. for workers. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: Minimum wages Act.<\/li>\n<\/ul>\n<ol start=\"8\">\n<li><strong><u>Article 43A<\/u><\/strong> &#8211; Participation of workers in management of industry. [<em>Socialist principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Inserted by 42<sup>nd<\/sup> Amendment Act 1976.<\/li>\n<li>Example: Industrial Disputes Act; Trade unions Act etc.<\/li>\n<\/ul>\n<ol start=\"9\">\n<li><strong><u>Article 43B <\/u><\/strong>&#8211; Promotion of Co-operatives [<em>Gandhian principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: Co-operative Society Act.<\/li>\n<li>Inserted by 97<sup>th<\/sup> Amendment Act, 2011.<\/li>\n<\/ul>\n<ol start=\"10\">\n<li><strong><u>Article 44<\/u><\/strong> &#8211; Uniform civil code [<em>Liberal-Intellectual principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Uniformity of laws in personal matters like Marriage, Divorce, Maintenance, Succession and adaption etc.<\/li>\n<li>Example: Hindu marriage act, Indian Christian marriage act, Special marriage act, Muslim Personal Law (Shariat) Application Act 1937 etc.<\/li>\n<\/ul>\n<ol start=\"11\">\n<li><strong><u>Article 45<\/u><\/strong> &#8211; Early Childhood care up to 6 year. [<em>Liberal-Intellectual principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Amended by 86<sup>th<\/sup> Amendment Act.<\/li>\n<li>Example: ICDS, Immunization drive etc.<\/li>\n<\/ul>\n<ol start=\"12\">\n<li><strong><u>Article 46<\/u><\/strong><strong> &#8211;<\/strong> Promotion of educational and economic interest of SC\/ST other weaker section. [<em>Gandhian principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: EWS reservation; model schools for ST; Stand up India etc.<\/li>\n<\/ul>\n<ol start=\"13\">\n<li><strong><u>Article 47<\/u><\/strong> &#8211; Duty of state to raise level of nutrition and standard of living and improve Public health [<em>Socialist principle<\/em>] and prohibition of consumption of intoxicating drink. [<em>Gandhian principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: MDM scheme; PDS national health mission etc.<\/li>\n<li>Liquor banning policy by states life Kerala, Bihar, Gujarat etc.<\/li>\n<\/ul>\n<ol start=\"14\">\n<li><strong><u>Article 48<\/u><\/strong> \u2013 Organization of agriculture and animal husbandry on scientific lines and prohibition of slaughter of cows and calves etc. [<em>Gandhian principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Green revolution; White revolution; Pink revolution, cow slaughter banning laws in states like Gujarat etc.<\/li>\n<\/ul>\n<ol start=\"15\">\n<li><strong><u>Article 48A<\/u><\/strong> &#8211; Protection and improvement of environment and safeguarding of forest and wild life. [<em>Liberal-Intellectual principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Inserted by 42<sup>nd<\/sup> Amendment Act 1976.<\/li>\n<li>Example: Environment protection act 1986, Wildlife Act 1972, National Forest policy 1988.<\/li>\n<\/ul>\n<ol start=\"16\">\n<li><strong><u>Article 49<\/u><\/strong> &#8211; Protection of monuments, places and objects of National importance. [<em>Liberal-Intellectual principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: Prasad policy by Ministry of Tourism. 12 cities Amaravati, Gaya, Dwarka, Vellamkani etc\u2026 identified for Pilgrimage Rejuvenation and Spirituality Augmentation Drive (PRASAD).<\/li>\n<li>HRIDAY (Ministry of Urban Development); Heritage city Development and Augmentation Yojana.<\/li>\n<\/ul>\n<ol start=\"17\">\n<li><strong><u>Article 50 <\/u><\/strong>&#8211; Separation of Judiciary from Executive. [<em>Liberal-Intellectual principle<\/em>]<\/li>\n<\/ol>\n<ul>\n<li>Example: CrPC \u2013 provides for separation Executive and Judicial functions by Executive and Judicial magistrates.<\/li>\n<\/ul>\n<ol start=\"18\">\n<li><strong><u>Article 51<\/u><\/strong> &#8211; Promotion of international peace and security. Minorities Linguistic; 7th Amendment Act 1956.<\/li>\n<li><strong><u>Article 351<\/u><\/strong> &#8211; Directive for development of Hindi Language so it can serve as a medium of expression of all element of the composite culture of India.<\/li>\n<\/ul>\n<h3>#7 What are Fundamental Duties<\/h3>\n<ul>\n<li>Inserted as <strong>Part IVA<\/strong> of Constitution of India through the <strong>42<sup>nd<\/sup> Amendment Act 1976<\/strong>.<\/li>\n<li>On the recommendations of <strong>Swaran Singh Committee<\/strong>.<\/li>\n<li>Inspired by the constitution of erstwhile USSR.<\/li>\n<li>Inserted 10 Fundamental Duties originally in <strong>Article 51A<\/strong> (only one article in Part IVA).<\/li>\n<li>11<sup>th<\/sup> Fundamental Duty added through the 86<sup>th<\/sup> Constitutional Amendment 2002.<\/li>\n<li>Basic idea was to <em><u>balance rights with duties<\/u><\/em>.<\/li>\n<li>Fundamental Duties are Non-justiciable in nature.<\/li>\n<\/ul>\n<h3>#8 Provisions enshrined in Article 51A<\/h3>\n<p><strong><u>Article 51A \u2013 Fundamental Duties<\/u><\/strong><\/p>\n<ol>\n<li>To abide by the constitution and respect National Flag and National Anthem.<\/li>\n<li>To Cherish and follow the noble ideas of our National struggle for freedom.<\/li>\n<li>To Uphold and protect the Sovereignty unity and integrity of India.<\/li>\n<li>To defend the country and render National Service when called upon to do so.<\/li>\n<li>To promote harmony and spirit of common brotherhood and renounce practice derogatory to the dignity of women.<\/li>\n<li>To value and preserve the rich heritage of our composite culture.<\/li>\n<li>To protect and Improve Natural environment and have compassion for living creatures.<\/li>\n<li>To develop scientific temper, humanism and spirit of inquiry and reform.<\/li>\n<li>To safeguard public property and abjure violence.<\/li>\n<li>To strive for excellence in all spheres of individual and collective activity.<\/li>\n<li>Parents or guardian to provide opportunity for education to child up to 14 years.
