Experts appointed to these tribunals bring in special knowledge and experience.<\/li>\n<li><strong>Two<\/strong>, tribunalisation\u2019 of justice will be cost-effective, accessible.<\/li>\n<\/ul>\n<p><strong>What are the criteria for the appointment of Expert members to the tribunal?<\/strong><\/p>\n<p>As per the NGT act there are two criteria for the appointment of Expert members to the NGT tribunal. A candidate has to fulfil only one of them.<\/p>\n<ol>\n<li><strong>One based on qualifications and practical experience<\/strong>: a masters\u2019 or a doctorate in science, engineering or technology, with 15 years\u2019 experience in the relevant field, including five in environment and forests in a national level institution, is needed. The fields include pollution control, hazardous substance management and forest conservation.<\/li>\n<li><strong>Two, administrative experience in the field: <\/strong>This condition is not clearly defined<strong>.<\/strong> It merely stipulates 15 years\u2019 experience, of which five should have been in \u201cdealing with environmental matters\u201d in either the Centre or the State or any reputed institution.<\/li>\n<\/ol>\n<h5><strong>Why the appointment of Girija Vaidyanathan has been challenged?<\/strong><\/h5>\n<ul>\n<li>In Ms. Vaidyanathan\u2019s case, she has served in Environmental related sectors for only 28 months that is less than the prescribed criteria of 5 years.<\/li>\n<\/ul>\n<h5><strong>What did the court say?<\/strong><\/h5>\n<ul>\n<li>The court opined that the appointment is valid considering her tenure as Health Secretary<strong>.<\/strong><\/li>\n<li>However, the court declined to interfere with the appointment, as the jurisdiction of this matter comes under the domain of Parliament.<\/li>\n<\/ul>\n<h5><strong>What is the way forward?<\/strong><\/h5>\n<ol>\n<li><b>T<\/b>he government should redefine the criteria for appointments through administrative<strong> experience<\/strong> with clarity and objectivity.<\/li>\n<li>It needs to implement Supreme Court directions to constitute a <strong>National Tribunals Commission<\/strong> to supervise the appointment and functioning of tribunals. <strong>Source:<\/strong> <a href=\"https:\/\/epaper.thehindu.com\/Home\/ShareArticle?OrgId=GCU8GSIK9.1&amp;imageview=0\">The Hindu<\/a><\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Synopsis: Centre needs to enact rules for the selection of Experts in NGT Tribunals with clarity and objectivity.
