This <a href=\"https:\/\/forumias.com\/blog\/a-case-of-declining-judicial-federalism-in-india\/\">judgment is against <strong>federalism.<\/strong><\/a><\/p>\n<h5><strong>What were the reasons given by the Supreme Courts&#8217; five-judge Bench?<\/strong><\/h5>\n<ul>\n<li><strong>One,<\/strong> the Maratha community did not constitute a socially and educationally backward class.<\/li>\n<li><strong>Two,<\/strong> the law is against <strong>Indra Sawhney judgment<\/strong>. In Indra Sawhney case the court has disallowed reservations made in excess of 50% of the total available positions.<\/li>\n<li><strong>Third<\/strong>, the State governments had no independent power to declare a group as a backward class.<\/li>\n<\/ul>\n<h5><strong>What are the issues in the interpretation provided by the Supreme Courts&#8217; five-judge Bench?<\/strong><\/h5>\n<p>The reasoning that it violates <strong>Indra Sawhney judgment<\/strong> and State governments had no independent power to declare a group as a backward class is against the values of <strong>equality and federalism.<\/strong><\/p>\n<ul>\n<li><strong>First, the cap of 50% on the reservation of\u00a0 Indra Sawhney judgment <\/strong>does not come from the constitution<strong>. Articles 16(4) and 15(4) <\/strong>confer power on the government to make reservations, contains no such limitation.\n<ul>\n<li><strong>Also, in State of Kerala vs N.M. Thomas (1975), <\/strong>the seven-judge bench held that reservation was inherent in the Constitution\u2019s basic guarantee of equal treatment. This statement by the state high court contradicts the principle of capping reservation at 50%.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Second, <\/strong>the court&#8217;s interpretation that states do not have the power to declare groups as backward classes is misleading.\n<ul>\n<li>The <a href=\"https:\/\/forumias.com\/blog\/supreme-court-upheld-validity-of-102nd-constitution-amendment-act\/\" target=\"_blank\" rel=\"noopener\"><strong>102nd Constitutional Amendment Act <\/strong><\/a>forms the basis of court&#8217;s ruling.<\/li>\n<li>After the<strong> 102nd Constitutional Amendment Act <\/strong>granted constitutional status to the <strong>National Commission for Backward Classes<\/strong>,<strong> Article 342A,<\/strong> <strong>Article 366(26C) <\/strong>were introduced<strong>.<\/strong>\n<ul>\n<li><strong>Article 342A\u00a0<\/strong>stipulates that President may, notify groups of persons within a State deemed to be socially and educationally backward, after consultation with the state.<\/li>\n<li>Further,<strong> Article 342A<\/strong> states that Central lists could be altered only by the Parliament.<\/li>\n<li><strong>Article 366(26C) <\/strong>defines\u00a0 \u201csocially and educationally backward classes\u201d as such backward classes identified under <strong>Article 342A<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>Based on the provision of <strong>Article 342A,<\/strong> a majority on the Bench had made\u00a0 <strong>erroneous<\/strong> interpretation that, the Centre is empowered to identify socially and educationally backward classes similar to the preparation of the lists of Scheduled Castes and Scheduled Tribes and not the states.<\/li>\n<li>However, the five-bench ruling of the supreme court has overlooked two essential factors,\n<ul>\n<li>One, the term \u201cCentral List\u201d in Article 342A refers to the categorisation of groups as backward for the purposes of reservation of posts and seats under the Union government\u2019s control only.
