{"id":108862,"date":"2021-05-26T18:27:17","date_gmt":"2021-05-26T12:57:17","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=108862"},"modified":"2021-05-26T21:01:13","modified_gmt":"2021-05-26T15:31:13","slug":"new-it-rules2021-and-the-issue-of-non-compliance","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/new-it-rules2021-and-the-issue-of-non-compliance\/","title":{"rendered":"New IT Rules,2021 and the issue of non-compliance."},"content":{"rendered":"<h5><\/h5>\n<h5><strong>What is the News?<\/strong><\/h5>\n<p>The Ministry of Electronics and Information Technology (MeitY) has notified the <a href=\"https:\/\/forumias.com\/blog\/new-it-rules-for-social-media-and-ott-platforms-explained-pointwise\/\" target=\"_blank\" rel=\"noopener\">IT(Intermediary Guidelines and Digital Media Ethics Code) Rules,2021<\/a> in the Gazette on February 25th,2021.<\/p>\n<p>The Government had asked the significant social media intermediaries to comply with the rules within three months i.e. by 25th May 2021. However, many of these platforms are yet to comply with the new guidelines.<\/p>\n<p><strong>Note: <\/strong>Social media companies with more than 50 lakh registered users are considered as &#8216;significant social media intermediaries&#8217;.<\/p>\n<h5><strong>Key Provisions New IT Rules,2021<\/strong><strong>:<\/strong><\/h5>\n<ul>\n<li><strong>Firstly, <\/strong>Social media companies are\u00a0<strong>prohibited from hosting or publishing any unlawful information<\/strong>. This information is \u201cin relation to the interest of the sovereignty and integrity of India, public order, friendly relations with foreign countries, etc.<\/li>\n<li><strong>Secondly, If such information is hosted or published, the government can take down such information within 24 hours<\/strong>.\u00a0The user will be\u00a0<b>given a notice<\/b>\u00a0before his\/her content is taken down.<\/li>\n<li><strong>Thirdly, <\/strong>the government can direct messaging platforms to<strong>\u00a0tie the identity of the user with the message transmitted<\/strong>\u00a0by him\/her for strengthening\u00a0<b>traceability<\/b>.<\/li>\n<li><strong>Fourthly, <\/strong>the IT rules 2021 call for social media companies to\u00a0<strong>publish a monthly compliance report<\/strong>.<\/li>\n<li><strong>Fifthly, <\/strong>social media platforms are classified into\u00a0<b>two categories<\/b>\n<ol>\n<li><strong>Social media intermediaries<\/strong>\u00a0\u2013 Platforms that have a limited user base.<\/li>\n<li><strong>Significant social media intermediaries<\/strong>\u00a0\u2013 These are the platforms with a large user base.<\/li>\n<\/ol>\n<\/li>\n<li><strong>Lastly, <\/strong>the\u00a0<strong>significant social media intermediaries<\/strong>\u00a0have to follow few additional measures like:\n<ul>\n<li>These platforms should\u00a0<strong>have a physical contact address<\/strong>\u00a0in India.<\/li>\n<li><strong>Appointing a Chief Compliance Officer<\/strong>,\u00a0<strong>Nodal Contact Person, and a Resident Grievance Officer in India<\/strong>. All of them should be Indian Residents.\n<ul>\n<li>Nodal Contact Person will do 24\u00d77 coordination with law enforcement agencies.<\/li>\n<li>The Resident Grievance Officer must acknowledge the complaint within 24 hours, and resolve it within 15 days of receipt.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h5><strong>Possible outcome for non-compliance of New IT Rules,2021<\/strong><\/h5>\n<ul>\n<li><strong>The government <\/strong>can take action against companies if they do not comply with the new guidelines by citing Rule 7 of the IT 2021 Rules.<\/li>\n<li><strong>Rule 7 states <\/strong>that if any intermediary fails to comply with the guidelines, the provisions of Section 79(1) of the Information Technology Act,2000 shall not apply to such an intermediary.<\/li>\n<li><strong>Section 79<\/strong> of the IT Act provides the \u2018safe harbour\u2019 regime status to Social Media Intermediaries. This status provides protection against liability for content posted on their websites by third parties.<\/li>\n<li><strong>In other words,<\/strong> the social media platforms will <span style=\"text-decoration: underline;\">lose their intermediary status.<\/span> This implies that every user post on these platforms will be considered as posts published by the companies.
