{"id":111436,"date":"2021-06-10T10:36:36","date_gmt":"2021-06-10T05:06:36","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=111436"},"modified":"2021-06-10T10:36:36","modified_gmt":"2021-06-10T05:06:36","slug":"issues-with-recent-draft-rules-notified-by-the-lakshadweep-administration","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/issues-with-recent-draft-rules-notified-by-the-lakshadweep-administration\/","title":{"rendered":"Issues with recent draft rules notified by the\u00a0Lakshadweep administration"},"content":{"rendered":"\n<p><strong>Synopsis<\/strong>: The<a href=\"https:\/\/forumias.com\/blog\/new-lakshadweep-regulations-issues-and-rationale\/\" target=\"_blank\" rel=\"noopener\"> recent changes brought in Lakshadweep<\/a> Administration in the name of public purpose is against the public interest and ethos of the island.<\/p>\n<h5><strong>Background<\/strong>:<\/h5>\n<ul>\n<li>Recently, <strong>the <a href=\"https:\/\/forumias.com\/blog\/controversies-surrounding-administrator-of-lakshadweep\/\" target=\"_blank\" rel=\"noopener\">administrator<\/a><\/strong> of Lakshadweep brought changes to the following acts to promote infrastructural development to boost tourism.\n<ul>\n<li>Development Authority Regulation,<\/li>\n<li>Prevention of Anti-Social Activities Regulation,<\/li>\n<li>Lakshadweep Panchayat Regulation and<\/li>\n<li>Lakshadweep Animal Preservation Regulation<\/li>\n<\/ul>\n<\/li>\n<li>However, the proposed changes ignore the significance of cultural ecology, cultural geography and strategic location of Lakshadweep.<\/li>\n<li>These changes are also against the <strong>2019 Kerala HC<\/strong> judgement which had recognised the special status given to the inhabitants for protecting their ethnic culture and traditions.<\/li>\n<li>Now, the draft rules are challenged before the High Court of Kerala.<\/li>\n<\/ul>\n<h5><strong>What is unique about Lakshadweep?<\/strong><\/h5>\n<ul>\n<li>It is an egalitarian coconut tree owning society.<\/li>\n<li>It has little economic inequality along with high literacy and high unemployment.<\/li>\n<li>The Muslim community is designated as Scheduled Tribes.<\/li>\n<li>Coconut trees are the main agricultural crop and fisheries is the main economic activity.<\/li>\n<li>Fisheries employ the majority of the working population.<\/li>\n<li>Since solar electricity requires a large land area, electricity is generated through diesel generators.<\/li>\n<\/ul>\n<h5><strong>What are the two competing visions for the island\u2019s future?<\/strong><\/h5>\n<ul>\n<li><strong>NITI Aayog\u2019s vision 2019: <\/strong>It identified water villas and land-based tourism projects as the development issue faced by the islands.\n<ul>\n<li>It also suggested zoning-based land acquisition and focused on sustainable development.<\/li>\n<li>However, it ignores the fragile environment and culture.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Integrated Island Management Plan 2016:<\/strong> It was prepared under the guidance of the Supreme Court and the National Centre for Sustainable Coastal Management.\n<ul>\n<li>It had <strong>rejected \u2018home stays\u2019<\/strong> in view of the <strong>strict social customs <\/strong>and strong resistance of the vast majority.<\/li>\n<li>It also suggested that <strong>development programmes<\/strong> should be implemented<strong> in consultation with the elected local self-government bodies<\/strong><\/li>\n<li>It also recommended adherence to scientifically determined plans.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h5><strong>M<\/strong><strong style=\"background-color: var(--global--color-background); color: var(--global--color-primary); font-family: var(--global--font-secondary); font-size: var(--global--font-size-base);\">ajor concerns associated with the new changes in Lakshadweep administration<\/strong><\/h5>\n<ul>\n<li>Firstly, these changes are <strong>arbitrary<\/strong>, authoritarian and will destroy the way of life.<\/li>\n<li>Secondly<strong>, vague criteria of \u2018public purpose\u2019<\/strong> for acquiring private land will increase conflict.\n<ul>\n<li><strong>Dev Sharan vs State of Uttar Pradesh, 2011:<\/strong> SC observed that \u201cAny attempt by the State to acquire land by promoting a public <strong>purpose to benefit a particular group of people<\/strong> or to serve any particular interest at the cost of the interest of a large section of people especially of the common people <strong>defeats<\/strong> the very concept of <strong>public<\/strong> <strong>purpose<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>Thirdly, Since, the existing water balance is under stress, it is difficult to adopt tourism.\n<ul>\n<li>All the inhabited islands already have a scarcity of drinking water supply. Hence, the conventional method of sewage treatment is not feasible because of the coral sandy strata and high-water table.<\/li>\n<\/ul>\n<\/li>\n<li>Fourthly, arbitrary changes will affect the relationship between the state and society, resulting in <strong>trust deficit and misgovernance.<\/strong>\n<ul>\n<li>For instance, the powers of the panchayats have been withdrawn on grounds of corruption, two-child policy for election candidates, banning beef and allowing liquor only for tourists.<\/li>\n<li>Also, the new draft legislation has brought preventive detention for \u2018anti-social activities\u2019 whereas the island has no case of murder or smuggling by local people.<\/li>\n<\/ul>\n<\/li>\n<li>The Lakshadweep Administration has said the changes are in line with Maldives development road. However, it has adopted a very different strategy <strong>without the active participation of the public<\/strong>.<\/li>\n<\/ul>\n<p><strong>How the Maldives development strategy is different from the Lakshadweep administration?<\/strong><\/p>\n<ul>\n<li>Firstly, tourism in the Maldives is centred on water villas in uninhabited islands, ensuring that very few coconut trees are cut.<\/li>\n<li>Secondly, only limited homestays are allowed.<\/li>\n<li>Thirdly, Maldives has a <strong>\u2018one island, one resort\u2019 policy<\/strong> which has kept very little pressure on reefs low.<\/li>\n<li>Fourthly, since the rich and healthy reefs are essential for economic returns, its business model is about <strong>giving coral reefs economic significance<\/strong>.<\/li>\n<\/ul>\n<p><strong>Source: <\/strong><a href=\"https:\/\/www.thehindu.com\/opinion\/lead\/state-interventions-lakshadweeps-future\/article34764522.ece\"><strong>The Hindu<\/strong><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Synopsis: The recent changes brought in Lakshadweep Administration in the name of public purpose is against the public interest and ethos of the island.
