{"id":116004,"date":"2021-07-02T20:10:05","date_gmt":"2021-07-02T14:40:05","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=116004"},"modified":"2021-07-02T20:10:05","modified_gmt":"2021-07-02T14:40:05","slug":"compassion-caution","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/compassion-caution\/","title":{"rendered":"Compassion &#038; caution"},"content":{"rendered":"\n<p>Source: <a href=\"https:\/\/indianexpress.com\/article\/opinion\/editorials\/covid-19-pandemic-disaster-supreme-court-vaccination-policy-7385051\/\">Indian Express<\/a><\/p>\n<p><strong>Relevance<\/strong>: Recently, SC directed the government to release compensation for victims of Covid-19.<\/p>\n<p><strong>Synopsis:<\/strong>\u00a0 Why the Supreme Courts&#8217; directive to provide <strong>Exgratia compensation to <\/strong>the families of those who have lost their lives during the Pandemic is not a rational idea.<\/p>\n<p><strong>Background<\/strong><\/p>\n<ul>\n<li>Recently, the Supreme Court directed the National Disaster Management Authority to frame guidelines for compensation to the next of kin of families of those who died during the Pandemic.<\/li>\n<\/ul>\n<p><strong>Why the Supreme Courts&#8217; directive is not a rational one?<\/strong><\/p>\n<ul>\n<li>One, The SC\u2019s directive of ex-gratia payment, though in sync with the Act, does not do justice to its own reading of the pandemic\u2019s peculiarities.\n<ul>\n<li>The 2005 law\u2019s definition of a disaster as \u201ca catastrophe, mishap, calamity or grave occurrence in any area, arising from natural or man-made causes\u201d indicates that it was not framed to cater to the demands of a countrywide public health crisis.<\/li>\n<\/ul>\n<\/li>\n<li>Two, a Pandemic is not a one-time event, unlike other Disasters. The Pandemic is set to stay for a longer time. Learning to live with Covid-19 using vaccination and precaution is the key.<\/li>\n<li>Three, the use of the disaster management law is an ill-advised move because it could set a precedent in a country beset with several other health crises in addition to Covid-19.<\/li>\n<li>Fourth, such relief measures are best organized by local governments. For instance, some states have announced steps for those who have lost their sole breadwinner or children who have been orphaned.
