{"id":116479,"date":"2021-07-05T18:13:10","date_gmt":"2021-07-05T12:43:10","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=116479"},"modified":"2021-07-22T19:01:46","modified_gmt":"2021-07-22T13:31:46","slug":"trafficking-in-persons-prevention-care-and-rehabilitation-bill-2021","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/trafficking-in-persons-prevention-care-and-rehabilitation-bill-2021\/","title":{"rendered":"Trafficking in Persons (Prevention, Care and Rehabilitation) Bill, 2021"},"content":{"rendered":"<div><\/div>\n<div class=\"content-box-blue\"><strong>Present Status<\/strong>: Open for public suggestions till 14<sup>th<\/sup> Jul 2021<\/div>\n<h5><span id=\"About_Trafficking_in_Persons_Prevention_Care_and_Rehabilitation_Bill_2021\"><strong>About Trafficking in Persons (Prevention, Care and Rehabilitation) Bill, 2021<\/strong><\/span><\/h5>\n<ul>\n<li><b>Objectives: <\/b>\n<ul>\n<li>To prevent and counter trafficking in persons, especially women and children.<\/li>\n<li>To provide for care, protection, and rehabilitation to the victims, while respecting their rights<\/li>\n<li>To create a supportive legal, economic and social environment for the victims<\/li>\n<li>To ensure prosecution of offenders<\/li>\n<\/ul>\n<\/li>\n<li>The bill has <strong>increased\u00a0the scope of the nature of offenses of trafficking<\/strong> as well as the kind of victims of these offenses with stringent penalties.<\/li>\n<li><strong>Ministry<\/strong>: Women and Child Development (WCD)<\/li>\n<li>A previous draft of the bill <em>(The Trafficking of Persons Bill 2018)<\/em> was passed\u00a0in the Lok Sabha in 2018 but was never introduced in the Rajya Sabha.<\/li>\n<\/ul>\n<h5><span id=\"Key_Provisions_of_the_Bill\"><strong>Key Provisions of the Bill:<\/strong><\/span><\/h5>\n<ul>\n<li><strong>Definition:\u00a0<\/strong>The bill defines exploitation to include the exploitation of the person for prostitution or other forms. Which includes pornography, forced labour, forced removal of organs or illegal clinical drug trials.<\/li>\n<li><strong>Includes Transgender:\u00a0<\/strong>The bill extends beyond the protection of women and children as victims. It now includes transgenders as well as any person who may be a victim of trafficking.<\/li>\n<li><strong>Victim Definition:\u00a0<\/strong>The bill does away with the provision that a victim necessarily needs to be transported from one place to another to be defined as a victim of trafficking.<\/li>\n<li><strong>Application<\/strong>: The law will apply to <strong>all citizens of India<\/strong>, within and outside the country, persons on any ship or aircraft registered in India wherever it may be or carrying Indian citizens wherever they may be, and a <strong>foreign national <\/strong>or<strong> a stateless person<\/strong> who has residence in India. It also says the law shall apply to every offence of trafficking in persons with <strong>cross-border implications<\/strong>.<\/li>\n<li><strong>Punishment<\/strong>: The Punishment will be for a minimum of seven years period, which can go up to an imprisonment of 10 years and a fine of Rs 5 lakh. However, in cases of the trafficking of more than one child, the penalty is life imprisonment. In certain cases, even the death penalty can be sought.\n<ul>\n<li><strong>More severe penalties<\/strong> in case of aggravated offences, like death of a victim.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Nodal Investigative Agency:\u00a0<\/strong>National Investigation Agency (NIA) shall act as the national investigating and coordinating agency responsible for prevention and combating of trafficking in persons.<\/li>\n<li><strong>National Anti Trafficking Committee<\/strong>: Once the bill becomes an Act, the central government will notify and set up a National Anti Trafficking Committee, while state governments will set up these committees at state and district levels to ensure effective implementation.<\/li>\n<li><strong>Jurisdiction:\u00a0<\/strong>The bill will extend to all citizens inside as well as outside India. It will also be applied to every offence of trafficking in persons with cross-border implications.<\/li>\n<li><strong>Seizing of Property:\u00a0<\/strong>Property bought via trafficking as well as used for trafficking can now be forfeited, similar to that of the money laundering Act.<\/li>\n<li><strong>Expands coverage: <\/strong>The scope of the Bill vis a vis offenders will now also include defence personnel and government servants, doctors and paramedical staff or anyone in a position of authority.
