{"id":116989,"date":"2021-07-07T19:48:18","date_gmt":"2021-07-07T14:18:18","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=116989"},"modified":"2021-07-08T10:15:49","modified_gmt":"2021-07-08T04:45:49","slug":"hc-govt-free-to-act-against-twitter-for-it-rules-violation","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/hc-govt-free-to-act-against-twitter-for-it-rules-violation\/","title":{"rendered":"HC: Govt free to act against Twitter for IT rules violation"},"content":{"rendered":"<p><b>Source<\/b>:\u00a0<a href=\"https:\/\/timesofindia.indiatimes.com\/india\/hc-govt-free-to-act-against-twitter-for-it-rules-violation\/articleshow\/84190484.cms\" target=\"_blank\" rel=\"noopener\">Times of India<\/a><\/p>\n<p><strong>Relevance<\/strong>: New IT rules aim to regulate social media, digital news media, and Over-The-Top (OTT) content providers.<\/p>\n<h5><strong>Introduction:<\/strong><\/h5>\n<p>The Delhi high court recently said that the government was \u201cfree to take action\u201d against microblogging site Twitter for not following the <a href=\"https:\/\/forumias.com\/blog\/new-it-rules-for-social-media-and-ott-platforms-explained-pointwise\/\" target=\"_blank\" rel=\"noopener\">new IT Rules<\/a> and warned the platform it would be \u201cin trouble\u201d if it fails to comply.<\/p>\n<h5><strong>About the case:<\/strong><\/h5>\n<p>As per the New IT Rules, significant Social media intermediaries like Twitter, WhatsApp has to appoint a Chief Compliance Officer, Nodal Contact Person, and a Resident Grievance Officer (RGO) in India. All of them should be Indian Residents.<\/p>\n<p>The HC was currently hearing a plea alleging failure by Twitter to comply with the Centre\u2019s new Information Technology Rules.\u00a0The Court also observed that the three-month window was given to the intermediaries to comply with the rules.<\/p>\n<p>Despite the time window, the HC pointed out that only an interim RGO was appointed by Twitter. The Court observed this as a violation of Government rules.<\/p>\n<h5><strong>The Government argument in the case:<\/strong><\/h5>\n<p>The Central government has approached the SC seeking transfer of all petitions challenging the constitutionality of the Information Technology (IT) Rules, 2021, from various high courts to the top court.
