{"id":118619,"date":"2021-07-14T18:57:37","date_gmt":"2021-07-14T13:27:37","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=118619"},"modified":"2021-07-15T19:14:28","modified_gmt":"2021-07-15T13:44:28","slug":"moefcc-issues-sop-violations-may-lead-to-closing-demolition-of-projects","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/moefcc-issues-sop-violations-may-lead-to-closing-demolition-of-projects\/","title":{"rendered":"MoEFCC issues SOP: Violations may lead to closing, demolition of projects"},"content":{"rendered":"<p><strong>Source: <\/strong><strong><a href=\"https:\/\/indianexpress.com\/article\/india\/moefcc-issues-sop-violations-may-lead-to-closing-demolition-of-projects-7398763\/\">Indian Express<\/a><\/strong><\/p>\n<h5><strong>What is the News?<\/strong><\/h5>\n<p>The Ministry of Environment, Forests and Climate Change has issued the Standard Operating Procedure(SOP) to deal with cases of environmental violations.<\/p>\n<p><strong>Background<\/strong>:<\/p>\n<ul>\n<li>The SOP is a result of orders from the National Green Tribunal which earlier in 2021 directed the ministry to put in place penalties and an SOP for green violations.<\/li>\n<\/ul>\n<p><strong>Key Features of the SOP:<\/strong><\/p>\n<p><strong>Nodal Authority:<\/strong><\/p>\n<ul>\n<li><strong>The SOP gives powers <\/strong>to government agencies such as the CPCB, state pollution control boards and state environment impact assessment authorities to identify cases of environmental violations and take penal action against them.<\/li>\n<\/ul>\n<h5><strong>Categories of Green Violations:<\/strong><\/h5>\n<ul>\n<li><strong>Projects without environmental clearance: <\/strong>These are those projects where construction work including expansion of an existing project has begun without the project proponent having acquired environmental clearance.<\/li>\n<li><strong>Non-Compliance: <\/strong>These are those projects in which prior environmental clearance has been accorded to the project, but it is in violation of norms prescribed in the approval.<\/li>\n<\/ul>\n<p><strong>Non Permissible Projects:<\/strong><\/p>\n<ul>\n<li><strong>Projects <\/strong>that are not permissible for environmental clearance are to be demolished.<\/li>\n<li><strong>Projects <\/strong>which are permissible according to environmental law but which have not acquired the requisite clearance are to be shut down.<\/li>\n<\/ul>\n<h5><strong>Expansion of Project:<\/strong><\/h5>\n<ul>\n<li><strong>In cases of expansion of a project <\/strong>where environmental clearance has not been received, the government agency can force the project proponent to revert to the level of construction\/manufacturing before the expansion<strong>.<\/strong><\/li>\n<\/ul>\n<h5><strong>Permissibility of a Project:<\/strong><\/h5>\n<ul>\n<li><strong>Permissibility of the project <\/strong>shall be examined from the perspective of whether such activity\/project was at all eligible for grant of prior Environmental Clearance(EC).<\/li>\n<li><strong>For instance, <\/strong>if a <a href=\"https:\/\/forumias.com\/blog\/direct-cto-scheme-for-green-category-industries\/\">Red Industry<\/a> is functioning in a <a href=\"https:\/\/forumias.com\/blog\/what-are-crz-rules-which-the-demolished-maradu-flats-violated\/\">Coastal Regulation Zone (CRZ)-I area,<\/a> it means that activity was in the first place not permitted at the time of commencement of the project. Such projects shall be closed and demolished.<\/li>\n<\/ul>\n<p><strong>Penalties:<\/strong><\/p>\n<ul>\n<li><strong>In Violation cases, <\/strong>where operations have not commenced, 1% of the total project cost incurred up to the date of filing of the application (for instance a fine of Rs 1 lakh for a project worth Rs 1 crore) will be levied.<\/li>\n<li><strong>In cases <\/strong>where operations have commenced without the required environmental clearance, 1% of the total project cost and in addition 0.25% of the total turnover during the period of violation will be levied.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Source: Indian Express What is the News?
