Stan Swamy has attracted global criticism and questioned India\u2019s credibility and will for protecting human rights. The situation calls for establishing an audit system to review such cases that would prevent gross violation of justice and uphold human rights.<\/span><\/p>\n<p><b>Background<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong><a style=\"color: #ff0000;\" href=\"https:\/\/forumias.com\/blog\/bail-under-uapa-unlawful-activities-prevention-act\/\" target=\"_blank\" rel=\"noopener\">Issue of Bail under UAPA<\/a><\/strong><\/span><\/p>\n<h5><b>Global Criticism<\/b><span style=\"font-weight: 400;\">:<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The international experts and societies expressed <\/span><b>deep grief over the demise of Fr. Swamy, as Parkinson\u2019s disease made it difficult for him to hold cups or glasses.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Mary Lawlor, the United Nations Special Rapporteur on the situation of Human Rights Defenders, plainly made the accusation that he was arrested on \u201cfalse charges of terrorism\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The United States State Department expressed sadness at his death and called him a \u201cJesuit priest and tribal rights activist.<\/span><\/li>\n<\/ul>\n<h5><b>Way Ahead:<\/b><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Such opinion cannot be given primacy over India\u2019s core security interests. However, <\/span><b>diplomacy requires engagement with international liberal opinion, not wooden and inflexible assertions of general principles only.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Indian state should <\/span><b>keep in mind the humane principles<\/b><span style=\"font-weight: 400;\"> that it adopted at the time of independence.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The country pledged to achieve development not through an authoritarian polity but a democratic and liberal one, despite the obstacles and challenges that lay in the way.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The application of special laws should be <\/span><b>duly audited by the superior judiciary. <\/b><span style=\"font-weight: 400;\">There should be very strong evidence to substantiate charges under them, as jail is the rule and bail is the exception for those charged under special laws.<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Fr.
