{"id":120525,"date":"2021-07-22T19:05:03","date_gmt":"2021-07-22T13:35:03","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=120525"},"modified":"2021-07-24T11:04:47","modified_gmt":"2021-07-24T05:34:47","slug":"judges-must-put-themselves-in-the-shoes-of-parliament-sc","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/judges-must-put-themselves-in-the-shoes-of-parliament-sc\/","title":{"rendered":"Judges must put themselves in the shoes of Parliament: SC"},"content":{"rendered":"<p><b>Source<\/b><span style=\"font-weight: 400;\">: <a href=\"https:\/\/timesofindia.indiatimes.com\/india\/judges-must-put-selves-in-shoes-of-parliament-sc\/articleshow\/84624990.cms\" target=\"_blank\" rel=\"noopener\">Times of India<\/a>\u00a0<\/span><\/p>\n<h5><b>What is the news?<\/b><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court has recently quashed a Madras High Court verdict on the court&#8217;s power to set aside an arbitration award under <\/span><b>Section 34<\/b><span style=\"font-weight: 400;\"> of the Arbitration act.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The High Court had held that the court\u2019s powers to \u201cset aside\u201d an arbitral award also <\/span><b>included the power to modify<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h5><b>About the Case<\/b><span style=\"font-weight: 400;\">:<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The court passed the order on an appeal filed by the Centre against the HC order.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The solicitor general said that the Arbitration Act, 1996 was based on the UN Commission on International Trade Law\u2019s Model Law on International Commercial Arbitration, 1985.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It has specifically restricted the grounds of challenge and the consequent remedy, which is only to set aside or remit in limited circumstances.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h5><b>Why did the SC quash HC\u2019s verdict<\/b><span style=\"font-weight: 400;\">?<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">As per SC, including the power to modify an award in section 34 would be an encroachment in the domain of the legislature, thereby<\/span><b> violating the separation of powers.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In interpreting a statutory provision, a judge must put himself in the shoes of the Parliament and then ask whether Parliament intended this result.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Parliament had <\/span><b>very clearly intended that no power of modification of an award <\/b><span style=\"font-weight: 400;\">existed in section 34 of the Arbitration Act.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The bench said it is <\/span><b>only for the Parliament to amend<\/b><span style=\"font-weight: 400;\"> the provision in the light of the experience of courts in the working of the Arbitration Act, 1996.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Source: Times of India\u00a0 What is the news?
