The judgment relied heavily on the \u2018dying declaration\u2019 made by the victim prior to his death.<\/p>\n<h5><strong>What is the Dying Declaration?<\/strong><\/h5>\n<ul>\n<li><strong>The Dying Declaration <\/strong>is the statement of a person who had died explaining the circumstances of his death.<\/li>\n<li><strong>A dying declaration is considered<\/strong> credible and trustworthy evidence, based upon the general belief that most people who know that they are about to die, do not lie.<\/li>\n<li><strong>Section 32 <\/strong>of the Indian Evidence Act deals with the cases related to that person who is dead or who cannot be found.<\/li>\n<\/ul>\n<h5><strong>Who can record dying declarations?<\/strong><\/h5>\n<ul>\n<li><strong>Anyone can record<\/strong> <strong>the dying declaration<\/strong> of the deceased as per law. The law does not compulsorily require the presence of a Judicial or Executive Magistrate to record a dying declaration.<\/li>\n<\/ul>\n<h5><strong>Do dying declarations always need corroboration?<\/strong><\/h5>\n<ul>\n<li><strong>A dying declaration can form<\/strong> the sole basis of conviction. The rule requiring corroboration is merely a rule of prudence.<\/li>\n<li><strong>Several judgments have noted <\/strong>that it is neither rule of law nor prudence that a dying declaration cannot be acted upon without corroboration.<\/li>\n<li><strong>If the court is satisfied <\/strong>that the dying declaration is true and voluntary, it can base conviction on it, without corroboration.<\/li>\n<li><strong>But the court has to scrutinise<\/strong> the dying declaration carefully and must ensure that the declaration is not the result of tutoring, prompting, or imagination.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Source: Indian Express What is the News?
