{"id":121519,"date":"2021-07-27T19:49:13","date_gmt":"2021-07-27T14:19:13","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=121519"},"modified":"2021-07-27T19:49:13","modified_gmt":"2021-07-27T14:19:13","slug":"guardrails-of-privacy","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/guardrails-of-privacy\/","title":{"rendered":"Guardrails of Privacy \u00a0"},"content":{"rendered":"<p><strong>Source<\/strong>: <a href=\"https:\/\/indianexpress.com\/article\/opinion\/columns\/illegal-surveillance-privacy-protection-pegasus-attacks-democracy-7423715\/\">Indian Express<\/a><\/p>\n<p><strong>Synopsis<\/strong>: The allegations of targeted surveillance have a <strong>chilling effect on personal and civil liberties<\/strong> that are crucial for a democracy to function.<\/p>\n<h5><strong>Introduction:<\/strong><\/h5>\n<ul>\n<li>The recent allegations and reports by <strong>Arsenal Consulting and Amnesty International<\/strong> on targeted electronic surveillance of selected activists, politicians, journalists, businessmen, and even scientists are worrying.<\/li>\n<li>The sophistication of the attacks <strong>engenders a sense of resigned helplessness<\/strong>.<\/li>\n<\/ul>\n<h5><strong>How the recent reports reveal the vulnerabilities?<\/strong><\/h5>\n<ol>\n<li>First, as per Arsenal reports, in Bhima koregaon case there is clear evidence that the <strong>incriminating files were planted in the hard disks<\/strong> by unknown entities.\n<ul>\n<li>This was done even before the disks were seized.<\/li>\n<li>The offending files were apparently injected by planting a <strong>Trojan malware called NetWire<\/strong> by orchestrating some kind of <strong>phishing attacks<\/strong>.<\/li>\n<li>The presence of NetWire can apparently even be detected by some of the commonly available virus and malware scanners.<\/li>\n<li>Given that such attacks are a reality today, governments and legal authorities need to ensure that digital evidence arising out of such forensic analysis is admissible in courts.<\/li>\n<\/ul>\n<\/li>\n<li>Second, the <strong>Pegasus attacks described in the Amnesty International report are significantly more sophisticated.<\/strong>\n<ul>\n<li>They are <strong>\u201czero-click\u201d<\/strong> attacks that do not even require a mistake by a victim to be successful.<\/li>\n<li>It is <strong>difficult to detect attacks like Pegasus<\/strong> because they frequently change methods and signatures.<\/li>\n<li>Pegasus was apparently also designed to <strong>self-destruct on detection attempts<\/strong>.<\/li>\n<li>But according to the Amnesty report, it did not entirely succeed and left traces.<\/li>\n<\/ul>\n<\/li>\n<li>Third, <strong>data protection law is not sufficient<\/strong> to help victims seek redressal and hold the perpetrators accountable, as suggested by Justice BN Srikrishna.\n<ul>\n<li>Stealth attacks are not only difficult to detect but are also difficult to prove and easy to deny, so <strong>ex-post redressal will always be uncertain.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h5><strong>Way forward:<\/strong><\/h5>\n<ul>\n<li>Data protection law is still required.\n<ul>\n<li>A framework is essential for <strong>defining the contours of lawful surveillance and data processing<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>Need surveillance reforms and data protection standards.\n<ul>\n<li><strong>To analyze the proportionality<\/strong> of the surveillance requirements.<\/li>\n<li>To address the operational aspects of the legal and technical standards necessary for an effective privacy protection architecture.<\/li>\n<li><strong>Clear standards<\/strong> for defining authorisation chains.<\/li>\n<li>Maintaining tamper-proof logs, regulatory oversight, and audit.<\/li>\n<li>Ensure <strong>ex-ante prevention<\/strong> rather than ex-post detection of violations.<\/li>\n<\/ul>\n<\/li>\n<li>Opposition from within the organisations as well as <strong>strong public outrage and disapproval<\/strong> can be effective deterrents for misadventures like Pegasus.<\/li>\n<\/ul>\n<p>Neither law nor technology can be of much help.
