Their action resulted in destruction or damage to some items, amounting to a loss of Rs. 2.20 lakh.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Based on the Assembly Secretary\u2019s complaint, the police registered a case and later filed a charge sheet against them.<\/span><\/li>\n<\/ul>\n<h5><b>About the case<\/b><span style=\"font-weight: 400;\">:\u00a0<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The MLAs were booked for committing mischief and trespass under the IPC and destroying public property under the Prevention of Damage to Public Property Act, 1984.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This year, the Chief Judicial Magistrate, Thiruvananthapuram, had rejected the application by the public <strong>prosecutor for withdrawal of the prosecution case<\/strong>. This order was affirmed by the Kerala HC. Later, the Supreme Court also concurred with this decision.<\/span><\/li>\n<\/ul>\n<h5><b>About the Supreme Court Directive:<\/b><\/h5>\n<ul>\n<li>A legislative privilege can not provide legal immunity to criminal acts of lawmakers.<\/li>\n<li>This ruling by Supreme Court is a step in the right direction, because,\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is an unacceptable argument that the alleged vandalism took place as part of the legislators\u2019 right to protest on the floor of the House.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">An alleged act of destroying public property within the House <\/span><b>cannot be considered \u201cessential\u201d<\/b><span style=\"font-weight: 400;\"> for their legislative functions.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\">It is the court\u2019s duty<b> to decide whether the prosecutor\u2019s withdrawal is in good faith and in the interest of public policy.
