However, the bill has been criticised by the opposition as it was passed in haste and reckless manner.<\/span><\/p>\n<h5><b>Background<\/b><span style=\"font-weight: 400;\">:<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The legislative assembly of Goa passed the Goa Bhumiputra Adhikarini Bill, 2021 and 10 other bills in its recent assembly session.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The bills were passed even though 12 Opposition MLAs walked out on the last day of the three-day Assembly session.<\/span><\/li>\n<\/ul>\n<h5><b>About the bill<\/b><span style=\"font-weight: 400;\">:<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It recognises anyone living in the state for 30 years or more as a <\/span><b>\u2018Bhumiputra <\/b><span style=\"font-weight: 400;\">(son of the soil)\u2019. It gives Bhumiputra the right to own his or her \u2018small dwelling unit\u2019 if the ownership was undetermined till now.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Once recognised as a Bhumiputra, <\/span><b>an individual can stake claim to ownership of their house of not more than 250 sq m, built before April 1, 2019<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It provides for the constitution of the <\/span><b>Bhumiputra Adhikarini<\/b><span style=\"font-weight: 400;\">. It is a committee consisting of the Deputy Collector as its Chairperson, and officials from the departments of Town and Country Planning, Forest and Environment. Mamlatdars of respective talukas are also part of the committee.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Bhumiputra may apply to the committee if his house has been built before the cut-off date. The committee will invite objections within 30 days, including from the land owner, which could also be a local body, and then take a decision of granting ownership to the Bhumiputra.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>An appeal against the Bhumiputra Adhikarini\u2019s decision can be filed before the Administrative Tribunal within 30 days.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It states that <\/span><b>no court shall have jurisdiction \u201c<\/b><span style=\"font-weight: 400;\">to entertain, decide or deal with any question which is to be decided by the Bhumiputra Adhikarini and Administrative Tribunal under this Act<\/span><b>\u201d.<\/b><\/li>\n<\/ul>\n<h5><b>Rationale behind its introduction<\/b><span style=\"font-weight: 400;\">:<\/span><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">To <\/span><b>provide a mechanism<\/b><span style=\"font-weight: 400;\"> to give ownership rights to the self-occupied dweller of a small housing unit.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">To enable him\/her to live with <\/span><b>dignity and self-respect and exercise his right to life<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h5><b>Why is the Opposition objecting to the bill?<\/b><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They said there was <\/span><b>not enough time <\/b><span style=\"font-weight: 400;\">in the curtailed Assembly session to study or debate the Bill, and 10 others passed \u201cin a haste\u201d.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It called this the ruling party\u2019s <\/span><b>\u201celection engineering\u201d and flagged concerns over illegal structures <\/b><span style=\"font-weight: 400;\">being regularised.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They said that the bill would recognise encroachments by slum-dwellers that are over 30 years old as Bhumiputras.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Source: https:\/\/indianexpress.com Synopsis: The legislative assembly of Goa passed the Goa Bhumiputra Adhikarini Bill, 2021 for giving ownership rights to Bhumiputra (son of the soil)\u2019.
