{"id":123354,"date":"2021-08-04T18:09:11","date_gmt":"2021-08-04T12:39:11","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=123354"},"modified":"2021-08-18T15:19:39","modified_gmt":"2021-08-18T09:49:39","slug":"no-dna-test-if-there-is-no-proof-of-adultery-supreme-court","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/no-dna-test-if-there-is-no-proof-of-adultery-supreme-court\/","title":{"rendered":"No DNA test if there is no proof of adultery: Supreme Court"},"content":{"rendered":"<p><strong>Source: <\/strong><a href=\"https:\/\/timesofindia.indiatimes.com\/india\/no-dna-test-if-there-is-no-proof-of-adultery-supreme-court\/articleshow\/85021297.cms\"><strong>TOI<\/strong><\/a><\/p>\n<h5><strong>What is the News?<\/strong><\/h5>\n<p>The Supreme Court has said that DNA tests cannot be ordered to establish the legitimacy of a child born during the subsistence of a marriage if there is no primary evidence of adultery.<\/p>\n<h5><strong>What was the case?<\/strong><\/h5>\n<ul>\n<li><strong>A man has petitioned the court to allow a DNA test <\/strong>of his child in a matrimonial dispute with his wife.<\/li>\n<\/ul>\n<h5><strong>What did the Supreme Court say?<\/strong><\/h5>\n<ul>\n<li><strong>The Court referred to Section 112 <\/strong>of the Indian Evidence Act which talks about the presumption of the legitimacy of a child.<\/li>\n<li><strong>The Apex Court said that the DNA test<\/strong> could not be straight away ordered to prove adultery.<\/li>\n<li><strong>There must be some primary evidence<\/strong> to prove the adultery allegation and only then the court can consider going for the scientific evidence of DNA testing.<\/li>\n<\/ul>\n<p><strong>Note: <\/strong>The act of adultery is voluntary sexual intercourse between a married person and someone other than that person&#8217;s current spouse or partner.<\/p>\n<h5><strong>Section 497 of IPC:<\/strong><\/h5>\n<ul>\n<li><strong>Section 497 of IPC <\/strong>says it is a punishable offense for a man to have sexual intercourse with a married woman without the consent of her husband. The man committing such an offence can be imprisoned for five years or more and can also be asked to pay a fine.<\/li>\n<li><strong>In 2018, <\/strong>the <strong>Supreme Court unanimously struck down Section 497<\/strong> of the Indian Penal Code.
