The promoter\u2019s work is to formulate new ideas and to develop it, and also persuade others to join the company.<\/p>\n<h5><strong>Key proposals<\/strong><\/h5>\n<ul>\n<li>Indian promoters can issue personal guarantees.<\/li>\n<li>Foreign assets can be pledged to raise funds for Indian entities<\/li>\n<li>Indian assets can also be pledged for raising funds for foreign entities<\/li>\n<li>NoC from banks to suffice instead of RBI permission in most cases<\/li>\n<li>\u2018Strategic sector\u2019, where govt would fix investment limit, introduced<\/li>\n<\/ul>\n<h5><strong>Present rules<\/strong><\/h5>\n<p>The rules were proposed through two draft guidelines on the RBI website. This is a change of stance by the central bank from its existing norms as spelt out in its <strong>Foreign Exchange Management Act (FEMA), 2000.<\/strong><\/p>\n<p>According to the earlier FEMA rules, giving of a guarantee or surety in respect of any debt or obligation is prohibited.<\/p>\n<ul>\n<li>by a person resident outside India; or<\/li>\n<li>by a person resident in India and owed to a person resident outside India<\/li>\n<\/ul>\n<p><strong>Rationale behind RBI\u2019s Draft proposal<\/strong><\/p>\n<ul>\n<li>The aim is to <strong>enable ease of doing business<\/strong> by offering fewer prior approvals and simplified processes.<\/li>\n<li>It will boost <strong>foreign direct investment<\/strong>.<\/li>\n<li>This is a major step towards <strong>capital convertibility<\/strong>.<\/li>\n<li>It tries to introduce a <strong>definition of \u2018strategic sector<\/strong>\u2019, which was missing in the earlier FEMA rules. \u201cStrategic sector\u201d will include energy and natural resources sectors such as oil, gas, coal and mineral ores or any other sector as advised by the Central government.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><strong>Terms to know<\/strong><\/span>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\"><strong><a style=\"color: #0000ff;\" href=\"https:\/\/forumias.com\/blog\/foreign-exchange-management-act-fema\/\" target=\"_blank\" rel=\"noopener\">FEMA<\/a><\/strong><\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Source: Business Standard What is the news?
