Critically explain. (GS 1)<\/span><\/p>\n<p><b>Introduction:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Whistle Blowers Protection Act, 2011<\/b><span style=\"font-weight: 400;\"> is an Act in the Parliament of India which provides a mechanism to investigate <\/span><b>alleged corruption and misuse of power by public servants and also protect anyone who exposes alleged wrongdoing in government bodies, projects and offices<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The wrongdoing might take the form of <\/span><b>fraud, corruption or mismanagement<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Act will also ensure <\/span><b>punishment for false or frivolous complaints<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><b>Need for amendment of Whistle Blowers Act, 2011:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The reasons for which the Whistle Blowers Act should be amended are as follows:<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The act covers only <\/span><b>central government employees; it does not include state government \/ private bodies.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Whistleblowers <\/span><b>commonly face retribution in different ways like, harassment, termination, blacklisting, threats and even physical violence.<\/b><span style=\"font-weight: 400;\"> For instance:<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Many Right to Information Act (RTI) activists, including policemen, have been harassed and even murdered for seeking information to promote transparency and accountability in the working of every public authority in India.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The law <\/span><b>lacks specific criminal penalties for these types of physical attacks on whistleblowers<\/b><span style=\"font-weight: 400;\">\u2014and given the number of violent attacks on complainants in the past, this is not a minor concern.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">There is a<\/span><b> 7-year time limit to bring complaints<\/b><span style=\"font-weight: 400;\">, dating from the time the alleged corrupt practices occurred.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">India\u2019s law <\/span><b>does not define \u201cvictimization\u201d and has a relatively narrow definition for \u201cdisclosure.\u201d<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This again <\/span><b>limits the effectiveness of any complainant safeguards<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><b>Whistleblower Protection Act (Amendment) Bill, 2015:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The loopholes of the Whistleblower Protection Act (Amendment) Bill, 2015 are as follows:<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Whistleblowers should not be allowed to reveal any documents classified under the <\/span><i><span style=\"font-weight: 400;\">Official Secrets Act of 1923<\/span><\/i><span style=\"font-weight: 400;\">, even if the purpose is to <\/span><b>disclose acts of corruption, misuse of power or criminal activities.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It also puts a <\/span><b>restriction on disclosure of any information<\/b><span style=\"font-weight: 400;\"> that could prejudicially affect the interest of sovereignty and integrity of India and good relations with foreign State.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The bill <\/span><b>puts bars on the activity of whistle blowing<\/b><span style=\"font-weight: 400;\"> in such a way that only some information obtained through RTI etc. has been kept in its ambit.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The bill has come under heavy criticism from <\/span><b>RTI activists and anti-corruption crusaders<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They are of the opinion that the bill has created <\/span><b>huge area of exceptions and due to which the state authorities would be out of reach of whistleblowers<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They also claim that the proposed amendments were <\/span><b>drafted without any kind of public consultation and participation.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The amendment Bill seeks to <\/span><b>remove immunity provided to whistle-blowers from prosecution under the draconian Official Secrets Act (OSA)<\/b><span style=\"font-weight: 400;\"> for disclosures made under the Whistleblower Protection law.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If whistle-blowers are prosecuted for disclosing information as part of their complaints and not granted immunity from the OSA, <\/span><b>the very purpose of the law would be defeated.<\/b><\/li>\n<\/ul>\n<p><b>Way Ahead:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The people must be made <\/span><b>aware about the act and its usage.<\/b><\/li>\n<li style=\"font-weight: 400;\"><b>Educating people is necessary<\/b><span style=\"font-weight: 400;\"> so that they can understand the benefits of disclosing the wrongdoings.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Incorporating state government \/ private bodies<\/b><span style=\"font-weight: 400;\"> will widen the scope of anti-corruption.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Individual\u2019s identity shall not be disclosed at any cost <\/b><span style=\"font-weight: 400;\">until unless they give their consent on it or it is required in the public interest.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight:
