{"id":127279,"date":"2021-08-19T20:08:34","date_gmt":"2021-08-19T14:38:34","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=127279"},"modified":"2021-08-20T18:33:11","modified_gmt":"2021-08-20T13:03:11","slug":"how-can-we-guarantee-the-speakers-impartiality","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/how-can-we-guarantee-the-speakers-impartiality\/","title":{"rendered":"How can we guarantee the Speaker\u2019s impartiality?"},"content":{"rendered":"<p><strong>Source:\u00a0<a href=\"https:\/\/indianexpress.com\/article\/opinion\/columns\/how-can-we-guarantee-the-speakers-impartiality-7460392\/\" target=\"_blank\" rel=\"noopener\">Indian Express<\/a><\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>Relevance: <\/strong>To understand the role of the speaker in the functioning of the Indian parliament<strong>.<\/strong><\/p>\n<p><strong>Synopsis: <\/strong>Either allow Parliament and state legislatures to descend into terminal decline or make the Speaker truly independent and let every legislature perform its constitutional function<\/p>\n<h5><strong>Introduction<\/strong><\/h5>\n<p>The main reason behind declining in the functioning of Parliament &amp; State assemblies is the lack of independence and impartiality of the speaker<\/p>\n<h5><strong>Features of Indian Constitution<\/strong><\/h5>\n<ul>\n<li>India adopted Westminster&#8217;s model of governance.<\/li>\n<li>Members of Parliament enjoy the same powers as that of the House of Commons.<\/li>\n<li>Speaker is the supreme authority in Lok Sabha (LS) like in the United Kingdom.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Role of Speaker<\/strong><\/p>\n<ol>\n<li>Being the supreme authority, his primary duty is to ensure the orderly conduct of the business of the House.<\/li>\n<li>There are two essential qualities of the office of Speaker: Independence and impartiality<\/li>\n<li>Speaker has the power to decide what issues will be taken up for discussion<\/li>\n<li>He has the sole discretion to permit an adjournment motion or calling attention notice if the issue is of urgent public importance.<\/li>\n<\/ol>\n<p>In the words of:<\/p>\n<ul>\n<li><strong>V Mavalankar <\/strong>\u201cOnce a person is elected Speaker, he is expected to be<strong> above parties, above politics<\/strong>\u201d<\/li>\n<li><strong>Pandit Nehru<\/strong> referred to the Speaker as \u201cthe <strong>symbol of the nation\u2019s freedom and liberty<\/strong>\u201d and emphasized that Speakers should be men of \u201coutstanding ability and impartiality\u201d<\/li>\n<li><strong>MN Kaul and SL Shakdher<\/strong>, in their book \u201cPractice and Procedure of Parliament\u201d refer the Speaker as the <strong>conscience and guardian of the House.<\/strong><\/li>\n<\/ul>\n<p><strong>Why the position of the speaker is under question<\/strong><\/p>\n<p>In various judgement of Supreme Court on Anti Defection, the court pointed out the main cause for the partisan role of speakers in assemblies. The main reason behind that is <strong>speaker belongs to the active ruling party.\u00a0<\/strong>This result in the frequent disruptions of the House.<\/p>\n<p><strong>Impact of frequent disruptions of house<\/strong><\/p>\n<ol>\n<li>It not only impacts the prestige of the house but also <strong>stalls the primary function of the legislature<\/strong>: to make laws for the good governance of the country with proper debates and discussions.<\/li>\n<li>Frequent disruptions lead to the <strong>passing of bills without much discussion<\/strong>. For e.g. in the present session, not a single bill was referred to any Parliamentary committee &#8211; as highlighted by Chief Justice of India.<\/li>\n<li>Another consequence is <strong>delegated legislation empowers the executive<\/strong> and bureaucracy. E.g. power of retrospective notification given to the executive.<\/li>\n<\/ol>\n<h5><strong>Suggestions<\/strong><\/h5>\n<p>Separation of power is the basic structure of the Indian constitution. If that ceases to exist, our foundation of democracy will get weaker.<\/p>\n<p>It is therefore suggested that the speaker of every legislature should resign from his political party to honour the constitutional obligation of impartiality &amp; independence.
