{"id":128016,"date":"2021-08-23T21:21:04","date_gmt":"2021-08-23T15:51:04","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=128016"},"modified":"2021-08-26T10:59:21","modified_gmt":"2021-08-26T05:29:21","slug":"womens-panel-defends-draft-inheritance-bill","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/womens-panel-defends-draft-inheritance-bill\/","title":{"rendered":"Women\u2019s panel defends draft Inheritance Bill"},"content":{"rendered":"<p><b>Source: <\/b><a href=\"https:\/\/epaper.thehindu.com\/Home\/MShareArticle?OrgId=GFL8TEIUP.1&amp;imageview=0\"><span style=\"font-weight: 400;\">The Hindu<\/span><\/a><\/p>\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The draft Arunachal Pradesh Marriage and Inheritance of Property Bill, 2021 has met with strong opposition in the State.<\/span><\/p>\n<p><b>About Draft Arunachal Pradesh Marriage and Inheritance of Property Bill, 2021:<\/b><\/p>\n<ol>\n<li><b>The bill<\/b><span style=\"font-weight: 400;\"> focuses on the provisions related to the legal status of marriage, the procedure of marriage registration, property right of the wife, widow\u2019s rights, treating polygamy as an offence.\u00a0<\/span><\/li>\n<li><b>The two significant contributions <\/b><span style=\"font-weight: 400;\">of the bill is with respect to the criminalization of polygamy (prospectively means second marriage held before the law comes into force will not be affected) and the property right of the legally wedded wife and widow.\u00a0<\/span><\/li>\n<\/ol>\n<h5><b>Why is the bill being opposed?<\/b><\/h5>\n<ol>\n<li style=\"font-weight: 400;\"><b>One of the clauses of the bill<\/b> deals with the \u2018Right of an <span style=\"font-weight: 400;\">APST (Arunachal Pradesh Scheduled Tribe)\u00a0<\/span>woman married to non-APST on immovable property owned and acquired by her\u2019.<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><strong>The clause states that<\/strong>\u00a0an <\/span><span style=\"font-weight: 400;\">APST woman shall enjoy the right of any immovable property owned and acquired by her in her lifetime.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>In the event of her death<\/b><span style=\"font-weight: 400;\">, her husband and her heir would have full rights of its disposal and alienation to any indigenous tribe of Arunachal Pradesh.<\/span><\/li>\n<li>This provision is seen as an invitation to outsiders to take over tribal land through marriage. Further, this provision is also considered against the customary practice.<\/li>\n<li style=\"font-weight: 400;\"><b>Hence, due to this,<\/b> <span style=\"font-weight: 400;\">the draft Bill is termed as <\/span><b>\u201canti-tribal\u201d, \u201canti-Arunachal\u201d<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ol>\n<h5><b>What do the organizations want now?<\/b><\/h5>\n<ol>\n<li style=\"font-weight: 400;\"><b>The Student Organizations has said <\/b><span style=\"font-weight: 400;\">that they will not allow the Bill to be passed in the State Assembly unless a tribal woman who marries anyone belonging to non-Arunachal Pradesh Scheduled Tribe (non-APST) is stripped of her ST status and benefits.<\/span><\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Source: The Hindu What is the News?
