What is the News?<\/b><\/p>\n

The Indian Government has planned to offer <\/span>indemnity to the financial bidders of <\/span>Air India Ltd<\/span>.<\/span><\/p>\n

Why is India planning to provide indemnity to Air India bidders?<\/b><\/p>\n

In 2020, Britain\u2019s Cairn Energy Plc had won an arbitration award for $1.2 billion-plus interest over a controversial retrospective tax demand from the Indian government. Recently, Cairn has secured an order from a French court<\/strong> authorizing the freezing of 20 Indian government properties in Paris<\/a>. This includes the assets of Air India also<\/strong>. Cairn Energy has also registered the arbitration award in several countries.<\/p>\n\n\n\n

Similarly, <\/b>Devas Multimedia <\/strong>has won a case against Antrix Corporation (a subsidiary of the Indian Space Research Organisation) for arbitrary cancellation of a contract.\u00a0<\/b>Devas Multimedia Pvt<\/span>\u00a0is also <\/strong><\/span>seeking to seize<\/strong> Air India\u2019s assets abroad<\/strong>.<\/span><\/p>\n

Due to this,<\/b> the potential bidders of Air India are afraid<\/strong> of encountering any<\/span> surprises on further liabilities. <\/span>Hence, <\/b>to give them assurance from any liability, the Government has <\/span>planned to offer <\/span>indemnity to the financial bidders of <\/span>Air India Ltd.<\/span><\/p>\n

Note<\/b>: India has recently passed the <\/span>Taxation Laws (Amendment) Bill, 2021, in Parliament. The bill <\/span>allows firms relief from the retrospective tax demands if they agree to drop litigation. The government is also in talks with Cairn to settle the dispute.<\/span><\/p>\n\n\n\n
