Hence, it has urged the <strong>company law tribunals to \u201cstrictly adhere\u201d to the timelines under the IBC<\/strong> and clear pending resolution plans.<\/span><\/p>\n<p><b>Note:<\/b> <span style=\"font-weight: 400;\">IBC mandates a 330 -day outer limit for the conclusion of the corporate insolvency resolution process (CIRP).<\/span><\/p>\n<h5><b>Background:<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Ministry of Corporate Affairs Standing Committee on Finance(2020-2021) has released a report titled \u2018<strong>Implementation of Insolvency and Bankruptcy Code- Pitfalls and Solutions<\/strong>\u2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The report has said that<\/span><span style=\"font-weight: 400;\"> more than 71% of the insolvency cases have been pending before the NCLT (National Company Law Tribunal) and NCLAT (National Company Law Appellate Tribunal)\u00a0 for over 180 days.<\/span><\/p>\n<h5><b>What has the Supreme Court said on judicial delays in Insolvency cases?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court has said that judicial delay should not become a reason for the failure of the Insolvency and Bankruptcy Code(IBC) regime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court said that the major reasons for judicial delays include <\/span><span style=\"font-weight: 400;\">NCLT taking the considerable time in admitting corporate insolvency resolution process (CIRP), multiplicity of litigation and appeals to the NCLAT and the Supreme Court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These inordinate delays cause commercial uncertainty, degradation in the value of the corporate debtor, and makes the insolvency process inefficient and expensive.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hence, it has <strong>urged the NCLT and the NCLAT to strictly adhere to the timelines<\/strong> stipulated under the IBC and clear pending resolution plans as early as possible.<\/span><\/p>\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">This post is based on the article<\/span><b> \u201c<\/b><strong>Don\u2019t let judicial delays fail IBC: Supreme Court<\/strong><b><\/b><b>\u201d<\/b> <span style=\"font-weight: 400;\">published in <strong>The Hindu<\/strong> on <\/span><b>13th September 2021.<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is the News?
