But these people would <strong>not be given Indian nationality<\/strong> under<strong>\u00a0<a href=\"https:\/\/forumias.com\/blog\/answeredrecent-citizenship-amendment-act-has-a-significant-impact-on-indias-secular-image-with-deeper-foreign-policy-implications-do-you-agree\/\" target=\"_blank\" rel=\"noopener\">Citizenship Amendment Act<\/a><\/strong>\u00a0because of the provisions mentioned in it. It provides <strong>citizenship only for those who have been in India since before December 2014<\/strong>.<\/p>\n<h5><strong>How Indian refugee policy is handled?<\/strong><\/h5>\n<p>India had hosted several refugees in the past like <strong>Tibetans<\/strong>, Tamil refugees from <strong>Sri Lanka<\/strong>, persecuted Chin and Afghan refugees and the minority Chakmas from the <strong>Chittagong Hill Tracts (CHT)<\/strong>. India also had received worldwide admiration for refugees who fled from then East Pakistan in 1970-71.<\/p>\n<p>But still, India <strong>doesn&#8217;t have any refugee-specific legislation<\/strong>. It is conditioned by ad hoc policies adopted by the government to deal with specific circumstances.<\/p>\n<h5><strong>How persecution (under the CAA) definition is different from United Nations?<\/strong><\/h5>\n<p><strong>United Nations Convention on the Status of Refugees, 1951: <\/strong>Under <strong>Article 1A (2), <\/strong>it defines a <strong>refugee<\/strong> as &#8216;people who are <strong>unable to avail the protection of their state and are forced to flee outside their country<\/strong> due to \u201c<strong>fear of persecution<\/strong>\u201d based on their \u201c<strong>race, religion, nationality<\/strong>, <strong>membership of a particular social group or political opinion\u201d.\u00a0<\/strong>It adopts a non-discriminatory approach.<\/p>\n<p><strong>India<\/strong>: It is <strong>discriminatory<\/strong> and adopts a <strong>narrow interpretation of persecution.<\/strong> It gives protection to<strong> persecuted minority communities<\/strong> \u2014 Hindus, Buddhists, Christians, Sikhs, Jains and Parsis \u2014 from <strong>Bangladesh, Pakistan and Afghanistan<\/strong> and <strong>not to the Muslims<\/strong>.<\/p>\n<p>The government gave the reason that since the three countries named are dominated by Muslims, it would not be necessary to consider Muslims as being persecuted in these countries.<\/p>\n<h5><strong>What is the intention of CAA?<\/strong><\/h5>\n<p>The intention of the citizenship amendment act is to<strong> confirm citizenship<\/strong>. It is <strong>not meant to provide protection for Asylum<\/strong> to the people belonging to other countries. \u00a0This was evident when the <strong>government did not grant Asylum to Rohingyas from Myanmar or Hazara from Afghanistan<\/strong>.<\/p>\n<p>This does not mean that they can not seek protection in India.
