Introduction<\/span><\/b>\u00a0<\/span><\/h5>\n

Recently, Supreme Court\u00a0questioned the\u00a0government\u00a0on\u00a0vacancies in the\u00a0National Company Law Tribunals (NCLT), and the National Company Law Appellate Tribunal (NCLAT).<\/span>\u00a0<\/span><\/p>\n

What are the implications of the vacancies?<\/span><\/b>\u00a0<\/span><\/h5>\n

First<\/em><\/strong>,<\/em><\/strong>\u00a0IBC\u00a0helps to\u00a0improve\u00a0India\u2019s ranking on the \u201cEase of Doing Business\u201d.\u00a0But\u00a0<\/span>vacancies in the tribunals have slowed down insolvency resolution due to the huge pendency of cases<\/span><\/b>. Both the NCLT and NCLAT have been without chairpersons for\u00a0many months and\u00a0also had members less than the actual strength.\u00a0Recently,\u00a0government appointed members\u00a0and chairpersons\u00a0to\u00a0both\u00a0NCLT\u00a0and\u00a0NCLAT.<\/span>\u00a0<\/span><\/p>\n

Second,<\/strong><\/em>\u00a0IBC was enacted with an object of time-bound resolution of debts, pendency of appeals. But\u00a0in\u00a0reality,\u00a0it\u00a0is leading to delay in the final resolution.<\/span>\u00a0<\/span><\/p>\n

Why a slower resolution process is bad?<\/span><\/b>\u00a0<\/span><\/h5>\n

Resolution applicants take a higher risk if the process is uncertain and if there is no fixed time for transfer of control of a corporate debtor to the successful applicant. A longer approval period means greater value erosion of a corporate debtor which would be an unattractive proposition for any prospective resolution applicant. <\/span>\u00a0<\/span><\/p>\n

This uncertainty can be cured by a faster approval process by the NCLTs by the creation of more benches and filling up of current vacancies.<\/span>\u00a0<\/span><\/p>\n

What steps can be taken?<\/span><\/b>\u00a0<\/span><\/h5>\n

First<\/b><\/em>,<\/em> along with filling up vacancies, the members being appointed must have sufficient domain expertise, and<\/span>\u00a0they must be provided with training.<\/span>\u00a0<\/span><\/p>\n

Second<\/b><\/em>,<\/em> we can\u00a0recover the lending process\u00a0which got disrupted due to COVID-19\u00a0by\u00a0supporting\u00a0the mechanism under the IBC to inspire confidence in creditors.<\/span>\u00a0<\/span><\/p>\n

Third,<\/em> <\/b>Supreme Court can make appointments by itself, and <\/span>it can take harsher steps like transferring jurisdiction under the IBC to high courts.\u00a0<\/span>\u00a0<\/span><\/p>\n
