These<\/span><span style=\"font-weight: 400;\">\u00a0rules have been notified under Section 6 of the <\/span><a href=\"https:\/\/forumias.com\/blog\/medical-termination-of-pregnancy-amendment-bill-2020-explained\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Medical Termination of Pregnancy Act, 2021.<\/span><\/a><\/p>\n<h5><b>What are the key provisions of the rules?<\/b><\/h5>\n<h6><b>Defines Special Categories of Women<\/b><\/h6>\n<p><span style=\"font-weight: 400;\">The act <\/span><span style=\"font-weight: 400;\">extended the upper limit for medical termination of pregnancy to 24 weeks, from the earlier stipulation of 20 weeks for certain special categories of women.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These special categories of women include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Survivors of sexual assault or rape or incest;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">minors;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">change of marital status during the ongoing pregnancy (widowhood and divorce);\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">women with physical disabilities;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">mentally ill women;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">foetal malformation that has a substantial risk of being incompatible with life or if the child is born, he\/ she may suffer from serious physical or mental abnormalities; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">women with pregnancy in humanitarian settings or disaster or emergency situations.<\/span><\/li>\n<\/ul>\n<h6><b>Opinion Needed for Termination of Pregnancy<\/b><\/h6>\n<p><span style=\"font-weight: 400;\">Opinion of <\/span><b>one Registered Medical Practitioner (RMP)<\/b><span style=\"font-weight: 400;\"> for termination of pregnancy up to <\/span><b>20 weeks of gestation.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Opinion of <\/span><b>two RMPs<\/b><span style=\"font-weight: 400;\"> for termination of pregnancy of<\/span><b> 20-24 weeks of gestation.<\/b><\/p>\n<p><strong>Earlier,<\/strong> abortion required the opinion of one doctor if it is done within 12 weeks of conception and two doctors if it is done between 12 and 20 weeks.<\/p>\n<h6><b>Formation of State level Medical Board Mandatory<\/b><\/h6>\n<p><span style=\"font-weight: 400;\">The rules make the formation of a state-level medical board mandatory, to decide if a pregnancy could be terminated after 24 weeks in cases of foetal malformation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, it would also be mandatory for the board to provide its opinion on the termination of pregnancy within three days of receiving the request for medic<\/span><span style=\"font-weight: 400;\">al termination of pregnancy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The rules also <\/span><span style=\"font-weight: 400;\">stipulate that the medical board will have the power to allow or deny termination of pregnancy beyond the 24 weeks of gestation period after due consideration and ensuring that the procedure would be safe for the woman.<\/span><\/p>\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">This post is based on the article <\/span><b>\u201c<\/b><b>Abortion allowed till 24 weeks of pregnancy in special cases<\/b><b>\u201d<\/b><span style=\"font-weight: 400;\"> published in<\/span><b> Indian Express <\/b><span style=\"font-weight: 400;\">on <\/span><b>17th October 2021.<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is the News?
