Interestingly, the <strong>NDPS Act excludes the seeds and leaves of the cannabis<\/strong> plant, though these are used in the making of bhang.<\/p>\n<h5><strong>What are some issues with present laws?<\/strong><\/h5>\n<p><strong>Bhang<\/strong>, a common and fairly potent intoxicant imbibed during festivals in north India is <strong>part of the culture<\/strong> and religion. It is<strong> sold in licensed shops<\/strong> in states such as Rajasthan and Uttar Pradesh. Cannabis seeds are also used in several eastern Indian <strong>cuisines<\/strong>.<\/p>\n<p>The irony is that though the law has reduced ganja and charas in India to a moral issue, cannabis <strong>consumption<\/strong> <strong>in all its forms continues unabated<\/strong>.<\/p>\n<p><strong>Ambiguous terms <\/strong>like \u201cconscious possession\u201d, provides executive bodies with discretion to exert itself according to their own interpretations, leading to further victimization of the accused.<\/p>\n<h5><strong>What are the reforms needed?<\/strong><\/h5>\n<p><strong>Compassionate approach<\/strong>&#8211; Users or Substance dependents should be treated as \u201cvictims\u201d and not \u201caddicts\u201d and sent compulsorily to rehab and treatment centres instead of to prison.<\/p>\n<p>In line with the <strong>UN resolution<\/strong>, government should <strong>decriminalise<\/strong> people in possession of <strong>small quantities<\/strong> of drugs for consumption.<\/p>\n<h5>What are the benefits of legalizing cannabis use?<\/h5>\n<p><strong>&#8211; <\/strong>It would free the NCB from exerting itself to define such legally ambiguous terms and focus its attentions on the real problem: The flourishing cross-border trade in heroin that is having such deleterious consequences for the youth in Punjab.<\/p>\n<p><strong>&#8211; <\/strong>Legalizing cannabis for recreational use can also bring benefits to tax collection, as seen in case of US&#8217;s states like Colorado and Washington.<\/p>\n<p><strong>Source<\/strong>: This post is based on the article \u201c<strong>Heady reform<\/strong>\u201d published in \u201c<strong>Business Standard<\/strong>\u201d on <strong>25th October 2021<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Synopsis: Implementing UN resolution on cannabis can help sort out some issues and has its own benefits.
