{"id":143208,"date":"2021-10-26T19:45:50","date_gmt":"2021-10-26T14:15:50","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=143208"},"modified":"2021-10-27T16:43:45","modified_gmt":"2021-10-27T11:13:45","slug":"chinas-border-law-the-why-what-what-next","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/chinas-border-law-the-why-what-what-next\/","title":{"rendered":"China\u2019s Border Law: The Why, What &#038; What Next"},"content":{"rendered":"\n<p><strong>Synopsis: <\/strong>The new land border law of China has its ramifications for India and therefore steps are needed to be taken by India.<\/p>\n<h5><strong>Introduction<\/strong><\/h5>\n<p>People\u2019s Republic of China\u2019s (PRC) passed a new law for strengthening China\u2019s border security management, will go into effect by January 1, 2022.<\/p>\n<p>Operationally, it enjoins the Chinese military to carry out border drills and provides state support for construction of border towns, strengthening of border defences and better integration of populations inhabiting border areas.<\/p>\n<p>It standardises how China patrols its massive 22,100 km land boundaries and borders with 14 countries.<\/p>\n<h5><strong>What led to the formation of this law?<\/strong><\/h5>\n<p><em><strong>First<\/strong><\/em>, the ongoing <strong>China-India military standoff<\/strong> in eastern Ladakh,<strong>\u201cGo West\u201d campaign<\/strong> in 1999-China has\u00a0 improved its land and rail connectivity to support its border infrastructure.<\/p>\n<p><em><strong>Second,<\/strong><\/em> China is concerned about <strong>illegal migration<\/strong> from Taliban-controlled Afghanistan and Central Asian countries, especially worried after <strong>US withdrew<\/strong> its forces from Afghanistan. UNSC\u2019s report highlights that the &#8216;East Turkistan Islamic Movement&#8217; fighters are also in Badakhshan province(northern Afghanistan) \u2013 next door to Xinjiang via the Wakhan Corridor. China worries about the possible spillover from Afghanistan, destabilising the restive Xinjiang Autonomous Administrative Region.<\/p>\n<p><em><strong>Third,<\/strong><\/em> China also worries about illegal immigration from Vietnam and Myanmar, which could perhaps bring more Covid-19 cases into the country.<\/p>\n<h5><strong>What are the implications for India?<\/strong><\/h5>\n<p><strong>Impact on boundary dispute resolution <\/strong>&#8211; India-China border standoff resulting from Chinese encroachment of eastern Ladakh has little chance of bilateral resolution.<\/p>\n<p><strong>Demography<\/strong> <strong>of border areas<\/strong> &#8211; The new border law is in sync with the policy of settlement of Han Chinese in newly constructed Chinese border towns,which till now is dominated by ethnic minorities, cannot be ruled out. Such a development is bound to significantly change the border dynamics with India.<\/p>\n<p>The \u201c<strong>dual civil and military use\u201d of border villages<\/strong> is thus a concern for India as it would lead to border population creeping in Indian areas. Later during discussion on the border between the two sides, China can claim to have settled population in this area.<\/p>\n<p>The land border law encourages Chinese border personnel to continue indulging in the use of force along the land borders \u2013 especially with India and Bhutan \u2013 with added <strong>legal protection and legitimacy<\/strong>.<\/p>\n<p>Law gives the <strong>responsibility of the border clearly to the PLA<\/strong> with a lack of clarity on who among the Ministries of Home and Defence is responsible for border management.<\/p>\n<h5><strong>What steps should be taken by India?<\/strong><\/h5>\n<p><strong>In short term:<\/strong><\/p>\n<p>The temporary on-ground adjustments like the establishment of the no-patrolling zone at Pangong Tso should be continued.<\/p>\n<p>India needs to deploy its army along the LAC in sizeable strength and for extended durations to prevent further Chinese ingress.<\/p>\n<p>China\u2019s bordering countries \u2013 especially India and Bhutan \u2013 need to be cautious about the intensification of Chinese activities along the disputed borders and see the evolving role of different PLA services and border defence units under PLA\u2019s new joint operational military guidelines.<\/p>\n<p><strong>In long term:<\/strong><\/p>\n<p>India should rethink the possibility of a &#8216;modus vivendi&#8217; with Beijing as an aggressive, inflexible and belligerent China is here to stay.<\/p>\n<p><strong>Source:<\/strong> This post is based on the articles \u201c<strong>China\u2019s Border Law: The Why, What &amp; What Next<\/strong>\u201d published in &#8220;<strong>Times of India<\/strong>&#8221; on <strong>26th October 2021 <\/strong>and &#8220;<strong>Beijing\u2019s Message<\/strong>&#8221; published in &#8220;<strong>Times of India<\/strong>&#8221; on <strong>26th October 2021.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Synopsis: The new land border law of China has its ramifications for India and therefore steps are needed to be taken by India.
