Under this act,\u00a0the innocent-until-proven-guilty principle is reversed to the guilty-until-proven-innocent principle.\u00a0The burden of proof of proving himself innocent is on accused.\u00a0<\/span>\u00a0<\/span><\/p>\n

Section 37 places limitations on\u00a0granting of bail for offences under the NDPS Act,\u00a0through 2 conditions:\u00a0<\/span>\u00a0<\/span><\/p>\n

  1. Firstly, that there are<\/span>\u00a0reasonable grounds<\/span><\/b>\u00a0for believing that the accused is not guilty of such an offence.\u00a0<\/span>\u00a0<\/span><\/li>\n
  2. Secondly, the person is not likely to commit any offence while on bail.<\/span>\u00a0<\/span><\/li>\n<\/ol>\n\n\n\n
