Chennai bar commission has in fact raised many valid questions.<\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read here:\u00a0<a href=\"https:\/\/forumias.com\/blog\/a-routine-matter-or-a-punishment-post\/\" target=\"_blank\" rel=\"noopener\">A routine matter or a punishment post?<\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h5><strong>What are the questions raised by the Chennai bar commission?<\/strong><\/h5>\n<p>The bar raised questions like:<\/p>\n<p>-What is the rationale behind transferring a judge heading a High Court with a sanctioned strength of 75 judges to a much smaller High Court with four judges.<br \/>\n-Whether all the procedural checks in the memorandum of procedure were followed.<\/p>\n<h5><strong>What does the Memorandum of Procedure say?<\/strong><\/h5>\n<p><strong>Paragraph 25.2 of MoP<\/strong>: CJI should ascertain the views of Supreme Court judges knowledgeable of High Court concerned.<\/p>\n<p><strong>Paragraph 25.3 of MoP:<\/strong> CJI and four senior-most SC judges should seek the response of the judge to be transferred and his preferred choices of destination.<\/p>\n<h5><strong>What should be the way forward?<\/strong><\/h5>\n<p>The Supreme Court had already struck down <a href=\"https:\/\/forumias.com\/blog\/national-judicial-appointments-commission\/\" target=\"_blank\" rel=\"noopener\"><strong>NJAC<\/strong><\/a> citing independence of the judiciary. But this independence should also ensure accountability.
