News<\/span><\/b>– Rising Pollution level\u00a0is\u00a0a health hazard and a violation of Article 21<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

India is currently ranked the\u00a0fifth-most polluted country in the Global Air Quality Index\u00a0list.\u00a0\u00a0\u00a0interventions dictated by policies, so far, have been binary in nature. This is primarily because we have been treating air pollution as a technological problem or as one that requires the actions of individuals alone,\u00a0<\/span>whilst ignoring its social and political facets<\/span><\/b>.\u00a0Political action becomes crucial given the silent and short\u2013spanned, yet cyclical nature of air pollution.<\/span>\u00a0A shift from air pollution as a technological problem to a political one\u00a0<\/span><\/b>will enable parties to be held accountable\u00a0on this front.\u00a0<\/span>\u00a0<\/span><\/p>\n

How transition\u00a0of pollution\u00a0from technological\u00a0solutions\u00a0to social and political\u00a0solutions will happen?<\/span><\/b>\u00a0<\/span><\/p>\n

1)\u00a0<\/span>Public Interest Litigation\u00a0<\/span><\/b>–\u00a0<\/span>They Provide an excellent path to hasten policy drafting and enable public participation<\/span>.<\/span>\u00a0<\/span><\/p>\n

2)\u00a0<\/span>Raising issue of pollution as a Violation of Article 21<\/span><\/b>–<\/span>Degrading levels of air in cities can be approached as a violation of Article 21 of the Constitution. Article 21\u00a0<\/span>states \u201cno person shall be deprived of his life or personal liberty except according to a procedure established by law\u201d<\/span><\/b>.<\/span><\/b>\u00a0<\/span>As supreme court has reiterated in various of its judgements that meaning of<\/span>\u00a0life under\u00a0<\/span>Article 21 does not merely mean \u201cthe physical act of breathing, it does not connote mere animal existence or continued drudgery through life\u201d.<\/span><\/b>\u00a0<\/span><\/p>\n

This becomes much more important in the light of the facts\u00a0<\/span>that fund for\u00a0Union Ministry of Environment, Forest and Climate Change has been halved and also many Environmental laws have been repealed\u00a0those environmentalists\u00a0deem important.\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

3)\u00a0<\/span>Public Participation\u00a0<\/span><\/b>–\u00a0Huge public awakening is paramount to solve this crisis and this requires not just moral action but also a democratic one based on human rights<\/span>.<\/span>\u00a0<\/span><\/p>\n
