Although the consumer of justice has every right to critically examine every word of the judge spoken or written, none has the right to make personal attacks on judges.<\/p>\n<h5><strong>Instances of attack on the judges<\/strong><\/h5>\n<p><strong>ADM Jabalpur case, 1976:<\/strong> The court held that the right to life and personal liberty of a citizen under <strong>Article 21<\/strong> of the Constitution would remain suspended during the emergency. The judiciary is under so much criticism that they had to overrule the judgement.<\/p>\n<p><strong>Shashi Tharoor speech in Parliament:\u00a0<\/strong>He said that the judiciary had failed to stem the tide of militant majoritarianism. He further blamed that the \u201cjudiciary\u2019s inaction almost always favors those in power&#8221;.<\/p>\n<p><strong>Trinamool MP: <\/strong>criticized the transfer\u00a0of former Madras High Court Chief Justice as the Chief Justice of Meghalaya High Court.<\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read here:\u00a0<a href=\"https:\/\/forumias.com\/blog\/theres-a-need-for-transparency-in-transfer-of-judges\/\" target=\"_blank\" rel=\"noopener\">There\u2019s a need for transparency in transfer of judges<\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Also, the <a href=\"https:\/\/forumias.com\/blog\/collegium-system\/\" target=\"_blank\" rel=\"noopener\">collegium<\/a> is under question several times for transfer and re-transfer of judges.<\/p>\n<p><strong>Pending judgment on important cases:\u00a0<\/strong>Several cases of national importance and which are obstructing the fundamental right of citizens are waiting for the final judgements.
